I got a answer for your case, if you are referred for investigation by cic. There will be following reasons-
you might be a suspect for misrepresentation unde sec 38 of IRPA- i.e you had entered canada by using your exwife. if cic finds it correct and you are not citizen then CBSA will write a report on you under sec. 40 for your removal from canada.
second, you might be a suspect for relationship of convinience, if it got proved then not only you but your ex-wife will be removed fro canada if not citizen.
options for you- if cic got a report on you then you will be notified of hearings at immigration division. They may also require you for interview before writing report. if you lose at immigration division then you may appeal to IAD. and finally to federal court if allowed.
In the mean time- You may want to try to establish you in canada, do community work, get education or enrolled as student.
Thay have nothing to do with your criminal charges.
If you ex-wife had wrote anything to CIC, they it may not matter much as its natural but it had raised a red flags on your file. Even if your ex-wife will sponsor anyone in future she have to go through same process.
Let me give u my personal experience..
I had lived outside canada after landing for 2yrs 11 months.. In the mean time i got married and was living with my wife for 1 year.
then i returned to canada and applied for her sponsorship.. My application was similarly pulled up for review..
Every time i would call they would give me a similar timeline.. 6-18 months..
Eventually after 3 months i got a call from a agent from the cic office.. they wanted to verify that i was still residing in canada and working in canada.. Once she was satisfied my file moved ahead and my wife had her passport stamped with no interview in 4 weeks..
I would suggest there is nothing to panic, keep calling cic every month for status update..
Contacting immigration lawyer/expert is pointless.. they cannot help, until a concrete negetive reason has been given..
After 2-3 months of waiting contact ur local MP and try to get his help to speed up ur application..

But we are still trying to understand the cause behind FILE SEND TO INVESTIGATION
if anyone had similar case please reply us with your experience
Hi Meet..
I got the same reply "FILE SEND TO INVESTIGATION" until on one of my calls to CIC one of the agents inadvertantly told the reason.. Sometimes they list the reason on file but dont reveal it to u when u call..
For spousal catergory the causes can fall into the following
1> Suspition of Fradulent marriage (about 90% of the cases)
2> Status issue of primary sponsorer
3> Bad paper work for sponsorship file
Bad paperwork can lead to cases 1 and 2 also..
Solution is to wait for confirmed cause which the CIC is obliged to convey within their timeline of 6-18 months..
