Hello,
I applied to CIO for FSW-Category 3. I did a one year MBA from Sept 2008-Oct 2009 and from Nov 2009 till Apr 2010 worked on a PG Work permit. Am currently unemployed. But CIO told that my application is not eligible for processing and this is what they had to say:
"Although you have indicated that you are a Temporary Foreign Worker there is insufficient evidence on file that you have been legally working in Canada as a Temporary Foreign Worker for at least one year immediately before submitting your application. There is insufficient evidence on file that you are legally studying in Canada as an International Student for at least one year immediately before submitting your application"
The immediately before submitting your application was boldened in their reply.

I have the following questions:
1. are their others in the forum that applied for FSW-3 and got it approved. Can you provide case examples of your cases?
2. With a post-grad work permit, if you get a permanent job, will you qualify for arranged employment category?

Please let me know the answers for these questions.

1. In your case, if you can't prove that you have worked at least one year in Canada ( 37.5 hours per week) prior to submitting your application ... you are not eligible. If your work permit is valid till October 2010, there is a way you can get qualified.

2. Normally, an employer needs to file an Arranged Employment application with HRSDC and get it approved. If you are already working with an employer, if the employer gives you a permanent offer on indeterminate basis, you can qualify under Arranged Employment.

Thanks for your reply.
For point 1, my PG Work permit is valid till Dec 2010. Why should I have worked for atleast one year. I have studied as an international student for one year and then my status changed right? Am I missing anything here?

For point 2, If I just have the offer letter is it enough? You dont need HSRDC clearance or opinion?
