Strange Situation !!!! Help

We (I & family) had applied for Canadian Immigration long years back and have almost forgotten about it till last year, when we had to go for our medicals. Since Jan05, our passports were with CHC Delhi, awaiting a decision.
Since I travel abroad frequently on work, I have been submitting & taking back my pasport regularly from CHC.
This year we planned for a family holiday to St. Kitts in April. So as usual, I went to CHC to take our passports back so that we can apply for US visa etc. The officer was bit surprised that a decision have been pending in my case since Ja05 even if everything was in order.
So he asked me to come back in the evening to take back the passports. In the evening I was handed over not only the passports but with Landing papers and visa stamped on them. Wow..that was fast...all well isn't it?
No, here is my problem(may not be a problem after I hear from you experts) now, I'm flying into Toronto in mid april with family on my way to St. Kitts via Miami.
I land at Toronto and enter as Immigrant. Stay there for 2 days and finish applying for PR card and SIN card. Leave for St, Kitts on 3rd day on holiday.
But while flying back from St. Kitts, we need to change flights at Toronto (we do not plan to come out of the airport at all).
Now, I've applied for PR card and SIN card and left Canada. The Immigrant visa is only a single entry visa. What will happen when I re-enter canada to catch my flight to India?
After entering Canada initially and with proof of PR card & SIN card applied for, will I be treated as Canadian PR and will be allowed to transit through canada freely without any other visa.
Or do I have to apply for a trnasit visa while returning? (one cannot have two types of valid visa from same country)....

Please help.

The landed immigrant document is issued to you because the the govt feels that you genuinely want t o come and settle in Canada. In the event you have to get out in a short notice, as soon as you land and after applying for a PR card, then you may need a returning resident permit. Ideally, the PR card takes only few weeks (if you show the proof of return ticket). My parents got it in a month. You would be better off taking the PR card and returning resident permit before leaving Canada if you are still interested in settling in this country. Please note that when you board a plane to many countries in Europe (Even for transit) you require a visa with your indian passport if you dont have a PR card. This is checked few times at the airport. The reason you dont require visa while coming to canada is because of your canadian single entry immigrant visa

On a lighter note :p pherhaps CIC must have felt Mr Eastwest has lots of money since he keeps flying every year to different countries pherhaps he needs to pump in few thousands dollars in our economy to feed our old white souls by paying high taxes.
Just a light sarcasim on CIC

U need a PR card 2 re enter Canada . But for that u need 3-4 weeks .

So maybe on ur return while u r changing flights u may need a transit Visa . BTW if ur changing flights y do u need a Transit Visa also ??.Don't u simply go 2 the Transit section instead of Immigration if u wish 2 stay @ the Airport ?

I think u must pose this problem at the Counter itself when u submit ur application for PR Card in case u dont receive any replies here .

Thanks Everyone,

I would have normally stayed for full days to get my PR card before returning to India to wind-up things and move again permanently. But as mentioned in my earlier post, I went to CHC just to get back my passport (unstamped) so that we can go on the pre-planned holiday to Caribbean. and incidently we had our flights booked via Toronto to St. Kitts. We were going to fly by Air Canada and Air Canada takes care of the visa (transit or visitor) for all passengers transiting through Canada.
So we had not planned this trip for entering Canada as immigrants, but now that we have been issued the visa and landing papers we'll have to use this trip to enter and register in Canada.
I had a valid multiple entry visitor visa for Canada, which was cancelled by CHC when they issued my the Immigrant visa.

I've written to CHC Delhi with this wuestion/problem and they have not got back to me with an answer till now. I also went to VFS(the company who is now handling all the visa applications for Canada in India) office and they were clueless about this and directed me back to CHC, who wouldn't allow anyone to walk past the hired guards and speak to the concerned person.
Most of the people, I spoke to personally, said I don't require any visa as I'll be a landed immigrant/PR of Canada when I return to catch my flight, but I'm still not convienced. I don't want to break any rules/laws and be harrased at the airport.
I'll wait for few more days and then maybe gate crash at the CHC.

Thanks again and will look forward to inputs from fellow desis.
BTW, is it possible for someone here to call up the CIC Call Center in Canada (toll free) and enquire about this and help me out?

You will not get any answer from Call center in Canada. ( 1-800 number). they are unable to answer simple questions so forget it. They are all contact staff. Try to contact CHC , delhi.

Will you be calling ISD from India?
If so, you can kiss your settlement funds goodbye, because you will use up all of that money while on hold on their telephone system :jump3:

As for your situation, it is a very interesting one and I suggest you post it to the "Ask Immigration Expert" section and wait for a response there.

There are two facets of the situation - (1) you will be a PR at that point, so ordinarily, you should have a PR card (or a travel document) to enter Canada. However, you will only be in-transit and will not go thru immigration and customs - I am not sure how it plays out in that case.

(2) You will have to deal with the airline too - sometimes airlines apply their own rules and logic on who they will allow or not allow from boarding.
Once you tell them that you are PR, they will want to see the PR card (or travel document).
At that point, you will have to convince them that you are only in-transit.

The other question is whether Indian passport holders need transit visas for Canada or not - I don't know.
I suspect that they do (just like for the US and the UK).

If that is the case, then you will need to have either the transit visa or the PR card regardless.
But you cannot be issued a transit visa by CHC because you are already a PR ;)

Go figure that :cheers:
