My son met with a collision yesterday with another vehicle while entering a road from a mall driveway. According to him the other vehicle was over speeding and he had not seen the other vehicle while entering the road. Our car was hit from the front end taking out the bumper, grill , lights etc; The OPP has given a ticket to him saying that the other vehicle had the right of way and considering clean record for my son so far they gave him a minimum fine of CAD.85 and 3 demerit points. We have comprehensive cover with deductible of 1000. The vehicle has been towed and kept in pound by towing company due to after working hours. According to our insurance company they will collect the car from pound after the long weekend and arrange for repair. Since this is our first collision case , I would appreciate to have valued opinion from people having experience in such situation. I am ready to pay the fine but is there a way to get rid of the demerit points, since according to some people it will affect our future insurance premiums. The officer was a nice person and advised me that if he was in my position he would go for option 3 ie; trial option. Secondly should I follow the insurance instruction for repair at their recommended place or should I get it repaired from outside workshop? Your valued advice shall be appreciated.

Thanks

Demerit points have no affect on insurance premiums .
If accumulated a certain # of points than it takes away the driving privilege .
You can try a trial . In case officer is unable to make it to court the ticket might be withdrawn but Insurance company can still deem you at fault as someone has to pay for the damages regardless .
BTW hope your son didn't had any injuries which is most important .
Good luck .

I would doubt that demerit points would not affect the insurance premium. It will. that is another story.

Now your insurance premium will rise for sure. It will be be sky high.
If you take it to the insurance company's preferred location, he will charge 100% extra but he is bound to redo faulty work free of charge and for the insurance company. I would go with this option, if it was not my fault. Once I enjoyed 3 days of free car with gas for a minor accident which the insurance company claimed $ 1000 which could have been done for $ 200 at a chinese body shop.

Please take it to your mechanic and bill the insurance. If the actual work is $ 1000, ask your mechanic to bill you for $ 2000 (the insurance company mechanic will bill this amount anyways). You get $ 1000 extra. Anyways, you will pay for this in future insurance premiums but take advantage of the Canadian loophole.

I would suggest that you go the trail route , if you have lots of time and if your son will drive again as usual. Otherwise, just pay the fine , get the demerit points and go on business as usual.

Once to reduce my 2 demerit points, I hired a paralegal and lost $ 300m my license was suspended and I paid the fine + the demerit point was still there. Did not want to waste my time fighting the paralegel.

All the best.

Demerit Points DO NOT AFFECT INSURANCE. They only affect your ability to have a license.
http://www.mto.gov.on.ca/english/dan.../demerit.shtml

Convictions do affect the insurance on other hand .

This can be confirmed by calling your insurance broker .

I don't have to guide you if its worth scamming . If caught its a criminal record with imprisonment , heavy fines and denial for insurance in future.

I have had my truck "nudged" by three different drivers three different times and each time i got the repair costs assessed, collected the monies and I repaired it myself to the best of my skill; then I got tired of its ugly looks, spray painted it and sold off.... :) for 3 years, used taxis or beat the pavement (improved my health!) and now bought a small 2-door hatch and got insurance again. Now I pay a whopping 480 bucks a year!

I now use TD insurance! just a secet! shh
