Traffic Ticket for passenger seat belt violation




Would you suggest to go for a trial for plead guilty with explanation

This was a passenger in the rear seat, and ticket is for $240 with no demerit points. It does not affect the insurance.

If you go to trial, you will most likely offered a plea deal which could reduce the fine at least by 40%. I know that it could cost half a day's woth work but I would go to trial to get the experience of overall court system here.
But thanks for posting, I guess most of us take it easy on seat belts for the passengers on rear seats especially in minivans.
But looks like they are now coming to the levels of traffic hawaldar to increase their revenues....man there is not enough justification to have that many number of cops in the force.

Have you guys thought of the safety remnifications when travelling without the seat belts? Please pay the fine and make it safer for your family.

I see rear passengers don't wear seat belt most of the times but drivers always. What is the reason for that? Is the requirement different for the different type of vehicles? Is it mandatory for the rear passengers to wear seat belt not matter what type of vehicles they are sitting in?

Every person travelling in a motor vehicle must wear a seat belt or use a child safety seat. The penalty for seat belt infractions is a fine between $200 and $1,000. Convicted offenders will receive two demerit points.

That is right but even then passengers (16+) on rear seats hardly wear seat belts in cars. Drivers are so much responsible but rear passengers are not.
Any time I took a taxi I was never forced by the driver to wear seat belt unless I sit on the front seat.

For that matter "How about kids in school bus: do they wear seat belts "No".... there must be a similar rule there too"

School bus comes under one of the exemptions.. ::)

Seat Belt Exemptions
Seatbelt exemptions continue to include:

Driving a motor vehicle in reverse
People with medical certificates saying that they are unable to wear a seatbelt
People engaged in work that requires them to exit from and re-enter the vehicle at frequent intervals, as long as they are traveling less than 40 km/h
Police or peace officers while transporting a person in custody
Person in police custody while being transported
Employees and agents of Canada Post engaged in rural mail delivery
Ambulance attendants and any other persons being transported in the patient's compartment of an ambulance
Firefighters in the rear of a fire department vehicle while engaged in work that makes it impractical to wear a seatbelt
Taxi cab drivers while transporting a passenger for hire. When travelling alone in the vehicle, taxi cab drivers must wear a seatbelt.
For vehicles that were not manufactured with seatbelts, the following exemptions apply:

==>Buses (including school buses)
Other large commercial vehicles (over 4,536 kg), which do not require seatbelts to be installed in rear seating positions at the time of manufacture
Historic vehicles that were not manufactured with seatbelts

Well, there's nothing to argue on this. If you think your kids and family are safe without the seat belts, then don't go by the rule. But, if the safety is the first thing on your mind then buckle it up for everyone.

Nonetheless the underlying rule, seat belts for everyone in the car simply makes sense. Whether you wear one or not is entirely upto you, but then ready to pay the required fine if caught not wearing it.
