Recovering dues from company

Hi All,
Company in which my daughter was working , has shut, operations, without paying their dues, & vaccation pay ,can any body guide on what options are available to try and get our case reported to approriate authority.

Has the company declared bankruptcy? If yes , you can contact the trustee and register yourself as a creditor. If no , you need to send a notice by registered mail to their last known address. If there is no response within a reasonable time you need to get a lawyer to file a motion in the provincial court serving the area where the company's corporate headquarters is located.

Thanks for your reply, I am not aware of the bankruptcy, it is that the place from where they were operating is locked , I heard they have not paid their rent due to the place, there is no contact number for any responsible person. My daughter obtained her letter of termination from a co worker , 4 days after it was closed.

If the money is not much (< $2000) I would say forget it..It's extremely difficult in this country to get a debtor to pay.

You need to file a claim with the Ministry of Labour under the Employment Standards Act. You need to have proof of employment (appointment letter , paystub , T4 , etc.) They probably can do nothing if the business is bankrupt. Call them at 416-326-7160
