I was working with Hindustan Petroleum Corporation in India. I worked for 14 years in management position and resigned in 2004 to come over to Canada.
They have not yet settled my last dues even after I have written 30 emails and 10 letters . HR group is sitting on it saying that there is a case of 1994 which needs to be answered. This was also done as it was a false case talking about my actions from 1994 to 1999 in Aligarh S/Area, while I was transferred from Aligarh to lakhimpur Kheri in June 2004.
Is there any forum for complaints for issues like this? Has any body written to the office of PM , concerned Minister and President and recd any response? Is our high comission of any help in these issues? Any suggestions and advise would be more than welcome

Mr. Ghose

This is a matter of service rules. They are supposed to act within the parameters provided in your appointment letter as well as employment contract if any entered between you and them.

If they are taking more than the required time, you can always knock the doors of law. Sending a strong letter to the highest authority blaiming the lausy attitude of HR guy should help.

You may also like to discuss this issue with a local lawyer in Canada. Since you are in Canada now, please check whether under Canadian law, it is possible for you to file a suite against them here. Else, filing a suite in India will not be feasible for you.

I am afraid. Going to Consumer Forum will not help. They are meant basically to provide justice to Consumers. Mr. Ghosh is not a consumer of HPCL. He used to work there as an employee. So his complaint will not be entertained at the forum.

Actually, the Indian law system does not have much provisions for the professionals in employment. There are so many Acts available to protect the interest of Labour force but not for the people above supervisor level.

Anyways, still there are ways, like going to National Human Rights Commission or simply filing a suit againt the employer. But before that I guess it will be a good idea to correspond with the top management. Also, please meet a lawyer in Canada to check whether it is possible for you to sue your ex-employer in Canada itself so that they face difficulty in defending themselves. This will force them to give up and will agree for an out of the court settlement.

Yeah I was just reluctant to write to the top person. But I guess this is what I need to do now. I have tried following up with them like a gentleman but I realise that honesty and sincerity is adjudged as weakness.

Thanks for the feedbacks.
