Hello all!
Please tell me whether USA H4 visa/Dependent visa holder apply for PR-Skilled worker at Buffalo?
What is the meaning of lawfully admitted to USA?

Yes, you can apply for Cdn PR.

You are on H4 holding an I-94 that is valid and states you are an H4. That's what "lawfully admitted to USA" means.

May I know about any applicant who is on H4 in US and appying/applied at Buffalo for Skilled worker PR?
Because I am sending my application soon.
And one of my friend's husband applied at Buffalo and his application got returned stating that:
You need to provide I-797 (H1-B status) in order to give proof of 'lawfully admitted to USA'.
He don't have H1. All he have is H4 and I-94.
So I am scared also.
So everybody, Pl help me and my friend in this regard.

Well, you may have to support your application with your spouse's H1 (797) and I-94 along with a cover letter detailing why you are on H4 and what your situation is and why, you, who is on H4 will be the principal applicant for Canada as opposed to the spouse who is on H1.

Your lawful admission is entirely dependent on your spouse's lawful admission and presence. If the spouse on H1 loses the status, you lose your status. This is probably what the CIC is looking for.

If you can prove that your spouse has entered legally and is in the US legally with a valid status along with your status info, I don't see why there should be a problem.

Everything depends on how proficiently you can document your situation and support it with verifiable documentation.

i want to know that i am also interested in CANADA -PR..could u pls. tell me that what is status of yr application..? did they accept or not? if yes then can u pls provide me all document list u put with application...pls. help me i am in trouble here in USA..my wifes' I-140 denied and i want to move to canada and i am here on H4 and have master degree from USA in engineering..pls reply me ...
