Can a Dependent Visa Holder apply for a PR?

Hello,

My husband has a work permit which is valid for more than a year. I have come here as his dependent and I too got the work permit at POE. I'm yet to start searching for a job. I have about 8 years of work experience in India.

My questions are:

1. Can I apply for a PR? My husband is anyway applying for PR at Buffalo office. Can I apply separately? Or is it better if only he apply and later sponsor me?

2. How can we get the police clearance certificate? Can we get that certificate at Indian Consulate in Toronto?

3. What are the documents/certificates required for PR? We have all our original education certificates and work-related documents with us in Canada. Is that enough or is there something we need to get from India?

Don't apply separately - you will confuse the hell out of everybody.
Between your husband and yourself, calculate who has the highest points and then that person applies, with the other as dependent.
It is favourable if the person applying is currently working, but not mandatory.
Applying while not working (esp. if you haven't worked for some time) puts you at a disadvantage.

Yes, check their website for process.

Check the CIC website - it has all the information you are asking for.

Well actually, my husband has come here through an Indian company and he is working at customer's site. If he applies for PR then he will not get any points for arranged employment because his current employer is in India.

So, that way, both of our points are almost same. He gets slightly more because he has more years of experience.

Also, I understand that if only he applies for a PR and if he gets it, he will later have to sponsor me which will take some more years. Is that correct?

He can still get 5 points for adaptability if he's been working for 1 year or more.

Yes.
In fact, it is very hard to do that.
He should apply and show you as a dependent.
If he applies alone, both of you will have to sign all kinds of declarations on why you are not being included in the application with him.
It doesn't make any sense.
Have him apply as the primary applicant and show you as dependent - he will still get points for your education and experience.
Take a look at the CIC site - that will answer most of your questions.

Yeah, now I see your point.

But, just to clarify, if he adds me as a dependant, and if he gets a PR, will I also automatically get a PR?

Yes, your fate will be tied to his as far as immigration goes :)

Aw...!!

I had heard that even if husband gets a PR (and he has already declared his wife as his family member/dependant while applying for PR) his wife will not automatically get a PR. His wife should apply separately.

That is why I had asked so.
