Student Visa for myself and Dependent Visa for wife rejected

Hello,

I am in a really messed up situation right now, I got admission in a very good university in Vancouver for a certificate program and following the same I filed my papers to CHC through a consultant who helped me getting the admission in university. I think I was able to meet most of the criterions like funding or any other documentary stuff that were needed, however I just got my VISA result yesterday and it was denied.
I am just wondering what could be the reason?
The reason given by CHC for rejection is \"not well established\" and \"course not in line with previous studies\". I am confused about both of these reasons as I had sufficient funding as I was asked by my consultant and also the course is aboslutely in line as I am working in the same field and my earlier certificates are also in line with the course that I was going for.
I wanted to know that what is the best way of reapplying?
We had also filed for PR in 2007 under my wife's name for which I gave complete details to the CHC in my application for study, can this be the reason for denial?
is there any clause that if PR is applied then you cannot go in for studies?
Please reply urgently as I need to reapply again(my paymnet due date to university is very close). Please suggest the right way of handling this rejection.

You please contact the Consultant and get all of the details in writing from him. He has your files. He knows what the contents are. He should also know the courses applied for and the continuity of the course line and the reasons for the denial also. Now it is his duty to help you get out of this mess and you have paid him to look after the matters for you.

So, please leave our guess work out of it, because we know nothing about you or your case. Also it is not ethical to do so. Some Consultants will not help you if they find out that you have gone to the public forums to inquire and seek help.

Thanks a lot Fredie, I totally understand your concern which is very valid, but right now I am at a stage wherein I have lost faith in these guys and definately I am trying to find another lawyer who can help me handle this in better way but I am running really short on time. Can you answer my main query - is there is any clause that if you hav PR filed than you cannot go as a Student?

I cannot comment with just what it is that you are saying. One needs to look at the file" in toto". Then, determine as to the decision taken by the Officer who handled it. Then move about it in a way it can be brought into line and then resubmit it to them. It will take time and you may loose valuable time that you are not willing to loose, currently. But will have to settle down for it ultimately. If the current consultant is not competent, which I see from you statement, then you only have one more choice. Which as you state is go to a Lawyer.

I see you have made up your mind in that. So, please follow your instinct and it will, as you do see, cost you an additional amount. Some lawyers will provide you with initial consultation and analysis for a fee. Please avail that route first.

So, be prepared for it. I see your determination and perseverance and hope you succeed in it.

Canada is not the only country for study and settlement. Alternately, Australia is providing students with scholarships and attracting immigrants also. See if you can find anyone who can guide you side by side to move to that place. It is another option that is open to you. But that window of opportunity will also close soon.

Also, Freddie I just got to know from one of my freind that he has also got a rejection for a university in Toronto....and i know him personally i don't think money or any other paper work was a problem to him...could it be due to economic slowdown as more people can create more unemployment???
just a thought that came to my mind looking at these two cases...

I've been an international student in the US. From my experience, I can tell you that the outcome could have been different if you were to pursue a degree instead of a certificate course. These short term certificate courses are looked upon as a workaround to enter the country whereas the intention of pursuing a degree is taken more seriously.

Another thing, the consultant DID NOT help you in securing the admission (going by your statement that it is a reputed university and not a neighborhood community college). He took your money and hoped that you will get in, which you did and he claimed the credit for it.

Regarding your query that the denial was due your PR application in process...may be...may be not. May be, because you have already shown an intention of migrating to Canada and international students are generally expected to return back to their home country after they finish up their studies. May be not, because I did travel to Canada a lot on a visitor's visa while my PR application was in process. The only difference here is that I applied while being in the US.

This is what you can do when you apply again...

1. Once again make sure that you have sufficient funds to prove that you can afford a foreign education.
2. Get work experience letters from your current and previous employers to prove that the certificate course you plan to pursue is in accord to the work you have been doing.
3. If possible, get a letter from your current employer stating that if you finish up this certificate course, you will stand a much better chance of growing in your career.
