Hi,
All those desi canucks working in the US on TN...your advice is needed. I have an MBA from US (Took three courses in Information Systems) but the degree as such awarded to me is MBA with no mention of specializations. I would like to know if i can try for TN visa as a Computer Systems Analyst...if so ...please do let me know whether it will be a good idea to hire a lawyer...
any other stuff relating to TN is highly appreciated...I have been in the US on H1 before coming to Canada...(would they look into that thing as well)....are they relatively strict about work ex requirements..
Thanks
guys ...anyone...
A CSA per NAFTA's requirements need as follows:
---------------
Computer Systems Analyst
Baccalaureate or Licenciatura degree; or Post-Secondary Diploma or Post Secondary Certificate and three years' experience.
-----------------
If your bachelor's degree is not related to the occupation, the burden of proof is on you to demonstrate you can be a CSA. Your 3 courses in IS within an MBA program may not carry too much weight.
Do you have an employment offer? If so, what does the attorney of the employer think? He or she is the one that can guide you unless you can hire a competent immigration attorney by yourself.
At the end of the day, it will all depend on your visit to the POE and the interview with the TN adjudication officer at the POE.
Regarding your prior status in the US, in general, they review your history for any flags. Having been on H1 is in itself is not a flag, but they may query you in general, or they may not.
No one can definitively say whether or not you will receive a TN especially, when the degree is not related to the occupation.

How many years you have worked in US on H1B? Did you work as a Computer System Analyst?
We do a lot of TN visas. Therefore, answering to few of these questions might help me give you further information.
