I lawfully entered the United States and was maintaining
student status with out any difficulties, until December 14, 2006,
When I Was assaulted and robbed by two men on my Way to a study
group(One ofthe men had a gun, pointed it at my head,
cocked it and demanded my wallet. )
Over the next several months, i unknowingly suffered
post traumatic stress disorder and fell into depression. while I was in the rehab program at my school due to the miscommunication between my academic department office & the school's \"international center\" my SEVIS got terminated and apparently I fell out of status.Working with the
University School Officials, I attempted with the schoo1’s
support to have my status reinstated. Unfortunately, that ultimately
resulted in a denia1 after a grueling waiting of 9 months .apparently I accrued the unlawful stay from the day I fell out of status till the day I left US which is more than 18 months.
While waiting for the USCIS's decision I was detained at a greyhound bustation and I served 3 days of detention as well before I got bailed out.And I was told the arrest will go in my records.Also,
(I still have no clue how USCIS allows me to petition my f1 status for reinstatement and DHS detains me while the decision is pending with USCIS!?)
Later,I filed for voluntary departure and was granted the same by the immigration judge and I did leave US with in the specified date by the court.
Now, I am planning to immigrate to Canada(uncle is citizen in calgary), does my above US episode affects me in any way.Do I have to mention my detention ( there is a column which says” have you been arrested before?Did you break any law before other than traffic violations?) should I say YES or NO

I do not have any knowledge about your issue but Obama has now allowed illegal immigrants to stay and work legally in USA. You can explore that option.
Other option is to marry some fat (real heavywight) lady from USA. all that you have to say to her are few words of praise. Then divorce after a year or so. I have heard that that is what most Arabs do.
Canada also provides refuge to Gay/Lesbian/ Transgenders.

What is wrong with you. The person is asking for immigration to Canada and you are offering him advise on how to enter USA. Totally irrelevant and depressing.
To the OP:
Canada and USA are two different countries and you tiff with USA immigration authorities does not bother Canada.
However, since you were detained / arrested, you will have to state the facts / reality to Canada so that they can determine if it was a criminal offense or otherwise. If it is a criminal offence, Canada will treat you the same (for immigration), irrespective of whether it happened in USA, Timbuktu or Somalia.
If Canada, grants you immigration and you become a citizen of Canada, you may be prevented from entering USA but that will be according to USA laws.

I appeared before the judge and been granted the voluntary departure only after I got testified "clean" by the cops. I definitely dint commit any felony.infact I was a victim. so we can rule out that I suppose.just fyi they dint put any ban on me but more like .." its hard for u convince the visa officer as you have ur "history" with us regardless of all your plight. its just unfortunate" - immigration judge.
Sorry to hear about the stuff you went through.
Since you were in the US for some time, are you not required to get a FBI clearance or police report as part of your application? So if you don't mention this in your application and it then comes up in another report, you're asking for more trouble because it will appear you were hiding something. So I think you should include it. That said, it will still raise a lot of questions and even though you may not have done anything worng, the immigration officer's perpsective may be very different.
If I were you, I'd consult a good immigration lawyer in Canada before proceeding.

Dear decipheran,
I would suggest forget about Canada, it is not a heaven...even if you come to canada nothings gonna change...you will never forget what happened to you in US...
IMO stay back in India, I m sure you will do really good there...
Why you want to go through all that hassel/stress of immigration again.........rest is up to you...
