Do anyone know the procedure to remove a name from a land title? There are two home owners at the moment. I am trying to remove one person from title and mortgage. The person is no longer in canada. The person is permanently staying in india.
PLease help.
For removing someone from mortgage, you will have to do the paperwork through the financial institution involved. Please contact the financial institution. For that you will have to visit India. It is unlikely it will get done if both do not go in person.
I am not really sure if you need a lawyer but there is a site called kaanoon.com. Lawyers do charge some fee on that site to answer any Indian legal question you may have.

Please explain clearly for people to understand teh problem and post to you some good response to your question. Sure there is a way. If it is in Maharashtra it can be for next to nothing. Anywhere else, we can tell you how.
Why don't you express clearly and tell us a little bit more. We can surely help you if you tell us exactly what it is that you want us to know. USE X and Y or ABC etc., you don't have to give us the exact names. When you write "" The person is no longer in canada. The person is permanently staying in india."" That screws up everything.
Where is the property situated? Is it yours? Or belongs to some body else and you are trying to help. What seems to be the issue? It is O.K. to have TWO homeowners. It is also O.K. to have two different homes also.
Tell us a little more clearly and we will give you the best advice that would have ever given. Take it from there afterwards.

first, I would like to apologize for now explaining my self right and Also, Thank you very much for your replies Everyone.
so there are two owners on home title and mortgage.
A and B
A= canadian citizen
B= Was a work permit holder at the time of purchase of the house in 2004. His immigration did not work out so left canada and now in india and can not come to canada for medical reason. This person was added on title and mortgage for one reason which is to get the mortgage. to get the mortgage in 2004 was very tough and his income help get the mortgage. he has no canadian status anymore. he is only indian at this moment.
so heres the dilemma. Mr.A wants to refinance the mortgage but bank will not do it without B being in canada. A bank agent advised Mr.A to remove Mr.B from title and everything will be solved.
so i am wondering how do we go about removing Mr.B name from land title and mortgage?
As per Indian law, it is impossible to remove Mr. B without his physical presense and signature.
However the situation asked is pertaining to Canada.
The best option is to ask your municipality of how to remove Mr. B . It is so simple.
For such specific and complex questions, it will be very hard to get the right answer from CD.
Please contact your municipality (where you pay the taxes for the house) or RE lawyer.

Going by the thread's title I thought the property in question is in India. How about contacting the lawyer who was involved during closing for the property in question? Otherwise, there is a paid site for US/Canada called justanswer.com. I do not know if they have any real estate lawyers there but you can try.
