Hello team members,
I applied PR for my Dad in 2003 and he has gone through medical test twice.
Today we got letter from CIC New Delhi that they might not give him PR because as per subsection 38(1) of the Immigration and Refugee Act, a medical officer has concluded that his health condition might expected cause excessive demand on health or social services.
They have asked us to respond before 20th November-2006.
Anybody has gone through this kind of problem? Any solution!
We checked with one immigration lawyer and he said he had lost 3 cases in past for similar nature.
Please help me for solution.

How bad is the heart condition, is it a blockage , or has he gone through surgery & is doing fine now most elderly people have heart/BP or diabetes related conditions.............does it mean that they can not be given a PR , there must be some categorization..........ask the immigration experts
I had met this Principal Immigrant Applicant recently who was diagnosed with heart trouble in the medical check . He got himself operated and the same doctor gave him a clearance a second time. He is now in Canada with his family.

Thanks a lot Fido & Aziz. Now I can see some hope.
Immigration officer is saying that he has to go through By pass surgery/Angiogram, Knee replacement & hearing operation (Ear).It will cost us lot of money and time.
I will do anything to bring my Dad.
If we don't arrange operations in India then this case will go for appeal and then we have to run around behind Lawyers. Even after appeal we will not be sure that he will get his visa.
Once again thanks for your reply and if any body wants to share this kind of experience then I will greatly appreciate.
