Bollywood actor Sanjay Dutt has been summoned to appear tomorrow before the TADA court in Mumbai, which is likely to give verdict on his alleged role in the 1993 bomb blasts case.
Besides Sanjay, 46, the court today summoned seven others ---- Zebunisa Kazi, Yusuf Nallwalla, Samir Hingora, Ibrahim Musa Chouhan, Rusi Mulla, Kersi Adajenia and former additional collector of customs Somnath Thapa.
Except Thapa, the cases of others are linked with that of Sanjay who is alleged to have acquired a weapon and later destroyed it.
The court has convicted 86 people in the case and 23 accused have been acquitted. Verdict is to be pronounced against the remaining 14 accused, including eight who have been summoned tomorrow.
Sanjay is charged under Section 120-b IPC (conspiracy), Section 3 (3) of TADA (P) act for keeping three AK-56 rifles, ammunition, 9 mm pistol, its cartridges and hand grenades which were part of the consignment smuggled by Tiger Memon to set off a series of blasts in Mumbai on March 12, 1993.
The actor is also charged under Section 5 of TADA (P) Act for possessing weapons, Section 6 of the same act (for contravening provisions of other acts) and Section 3 and 7 read with Section 25 of Arms Act.
According to the CBI, Abu Salem, Baba Chouhan, Mansoor Ahmed, Samir Hingora and the late Hanif Kadawala had gone to Sanjay's house and delivered weapons including three AK-56 rifles, ammunition and hand grenades. Sanjay kept one AK-56 rifle and a pistol with himself and returned the rest of the arms which were taken away by Mansoor Ahmed from Sanjay's residence to the house of co-accused Zebunisa Kazi.
According to the CBI, Sanjay had requested his friend Yusuf Nallwalla to destroy the AK-56 rifle and 9 mm pistol. Nallwalla went to his friend Kersi Adajenia and destroyed the AK-56 at the latter's workshop with the help of a gas cutter.
However, the pistol could not be destroyed as Adajenia developed breathing problem due to the smoke generated in the process. As he had to leave for Kolkata on a business trip, Adajenia gave the pistol to his friend Rusi Mulla who in turn gave the weapon to his friend Ajay Marwah.
After Sanjay was arrested in the blast case on April 19, 1993, he reportedly spilled the beans and named his friends who allegedly helped him in destroying the rifle and hiding the pistol.
Hanif Kadawala, who was also charged with going to Sanjay's house with other accused, was shot dead by Chhota Rajan gang when he was released on bail and the case against him stands abated.
The CBI recovered a spring and a rod claiming that these were parts of the AK-56 rifle which was destroyed by Nallwalla and Adajenia at the instance of Sanjay.
Besides, police has recorded confessions of Sanjay and other accused who delivered arms to the actor and those helped him in destroying the weapon.
Under Section 15 of TADA (P) Act confession of an accused is considered as evidence and can be used against him as well as against other accused.
However, three witnesses -- watchman of Sanjay's residence and two policemen posted as security guards -- have turned hostile saying they had not seen anyone entering the bungalow to deliver arms to the actor.

He is not found guilty under TADA court and has not been found to be a terrorist. His explanation for obtaining the arms for self defence has been accepted. He is being charged under the arms control act and he is to surrender by December 19th and he may be sentenced for 2 to 3 years and based on the time already spent and commuting sentences for Gandhi Jayanthi he will go scott free within a few months.
