Upon my inquiry, here is what our corporate attorney's office had to say about the 3 yr TNs:
"For Mexican TN's only, I'm afraid. They are then given one year on their I-94 at POE. But, it saves two visa applications. No help for Canadians, I'm afraid".

Dimple, I did not understand the attorney's response. Can you please elaborate?

Mexicans need a visa and hence have to go through consular interviews. I guess, to eliminate the annual pilgrimage they have to take to the consulate, they are now given 3 yr validity on TN status and visa. However, their entry and stay is valid one year at a time by means of issuing one year valid I-94s.
Getting a new I-94 at the POE is much simpler than obtaining new TN status and visa every year from the consulate (or so I think is the logic).

Makes sense. Thanks for the clarification.
This is completely wrong that the 3 years TN is only applicable for maxican (consular visa).
It applies both Canadians and Mexicans.

* The long awaited three-year TN visa reform will come into reality soon as the OMB cleared yesterday the "final rule" of the 3-Year TN visas for Canadian and Mexican professionals as drafted by the USCIS. Since this is a "final" rule, the rule will take effect as a legally binding rule upon publication in the federal register unlike the proposed rule that requires additional steps to reach as a legally binding rule. Congratulations to Canadian and Mexican professionals. Please stay tuned this website for the release of this final regulation in the federal register.

Regards,
As reported from another site
"10/22/2008: Three-Year TN Update
* AILA has reported that it is the current USCIS practice that those TN applications which were pending before October 16, 2008 will be granted the period of stay which the TN employer asked or maximum one-year, whichever is less, and those applications which have been filed on or after October 16, 2008 will be given the period of stay the TN employer asked or maximum three years, whichever is less. Accordingly, if the employer filed the application before 10/16/2008 seeking less than one-year, the alien will be given a TN status for that period and not one-year which was the maxium under the rule before 10/16/2008. In the same token, if the employer filed the application on or after 10/16/2008 seeking less than three years, i.e. one year, the alien will be given a TN status valid for that period (one year in the illustration) and not three years. The three-year TN will be available only when the TN employer seeks the three-year employment and not less. In other words, the three-year TN is not, repeat not, automatic. It will depend on the employer's need as requested in the employer's letter. "
