Dear Mr. Masood,
I am trying to ask u this question since so many days but i m new to this site so cud not post in the right section. I have only 2-3 days left to make the most important decision of my life. My details are as follows:

* My wife electronics technician applied for the PR in 2000 and my and my daughter's names included as family members.
* We have got medical papers and our interview waived off. they have given us the 60 days time to submitt the medicals, passport, landing fee, Police Certificates. etc.
* I m Sub Insp in Chandigarh Police and my experience is 11 years.
* MY problem is my passport expired in Nov, 2003 and our officers r not issuing the No objection certificate for passport which is must for new passport and passport is must for medicals.
* I wanted that if i send the medical of my wife and daughter now and since she is principal applicant she gets visa and she can later sponser me from canada and then i resign from my post.
* but it is mentiond in the medical letter that all family members must undergo medical now whether accompanying to canada or not.
* Can my wife get visa without my medical and later sponsor me
* if it is not the case i will have to resign and get my passport prepared and send the medical to CHC within the stipulated time period ( 60 days).
* If the medical and other papers reach the CHC a few days later what action they can take.

* Please guide me i have to decide within next 2-3 days since i have already got the letter 10 days late.

thanks in anticipation of early reply

Not only your attitude, but even your name clearly signifies that you are so used to FREE things in life that even for your most important decision in life, you want free advice, which you already know has not come forth even after your begging for it!

Why don't you get up, go out and meet an expert personally and pay him for his advice and help, even if means that you might have to forego the dream of coming to Canada. Another senior desi of this forum Blue Lobster has already advised you in this direction but you are still waiting for FREE advice - which perhaps you can get from Masood's office in Delhi - but you don't want to walk a bit - just lie where you are. It is disgusting!

And imagine you want to come to a country where lawyers will ask you to pay even for the first meeting where you just want to tell them your case - forget about their decision to handle it or not!

Hello,
I don't claim to be an expert, just someone who is also in the process. From what I know about the medicals, you have to go for it along with your wife and kids. you don't need a passport for the medicals(at least i didn't need one in the US). However after that it is upto you whether you want to apply for the Visa or not. When the Canadian government asks for the passports and ROLF, send only your wife and kids' pasports and ROLF. If you haven't paid yet the ROLF, then that will be one less headache.
This will mean that you will be eligible later for family sponsorship but will most probably have to go for your medicals again.

As others have suggested, talk to an immigration expert for confirmaion and clarifications. The money spent may be a good investment. And then there is always the internet.

On a slightly different point, I wouldn't suggest you to quit the job unless you or your wife have a confirmed job in Canada.

Regards,
Souvik

Banjara: We do NOT charge for initial consultation. Heck, people keep coming back 2/3 times and we still give them free advice.

Wadasahib:
BEWARE MY FRIEND - If you don't do your medicals, your doors will be closed for ever. Your wife will not be able to sponsor you. I and a group of other lawyers are fighting another big battle in the federal court regarding exactly this same issue. Some consultants gave bad advice to their clients not to have spouse do medicals & the applicants landed in Canada and sponsored the spouses left behind. Section 117 says "NO WAY".

Believe me, you don't want to be trapped.

Write to the embassy and explain your situation. Have your wife & kids do their medicals. Do yours as soon as possible. [DON'T WORRY ABOUT THE 60 DAYS DEADLINE. IF THEY DENY YOU, I WILL GIVE THEM HELL]

By the way, I'll be in Chandigarh last week of June.
