Car hit from back - Insurance impact

Hi

I was asked this question recently and I am not familiar with this . Thought any of our members may know. Also would serve as information for people who may need it in future.

Driver A's car was hit at the rear by Driver B while B was trying to stop at traffic. The damage is minimal to both and driver B is proposing to settle it privately by offering to fix A's car at any shop chosen by A.

If driver A reports to the collision center (lets us leave aside the $1000 limit for this discussion) about the incident but makes no insurance claim , will the insurance of B be still raised at renewal time. Will insurance company know about this ?

Any first hand experience ?

Driver B has been rear ended, so technically it will Driver A's fault, unless Driver A can prove that Driver B, stopped on purpose without cause. Even then Driver A was following and should have control of their car and keep a safe distance so as to be able to stop safely.

I would say Driver B should just go to the Collision Centre and file a report.

No first hand experience but reporting a collision at the collision centre is independent of a claim being filed ... You may report it @ a collsion centre but decide not to file a claim ... No impact on Insurance if claim is not made ...

There s a 72 hour deadline for filing a collision at the centre .

If a Private settlement is agreed upon , write up a note the conditons of the private settlement and that neither party has / would complain to the Police or file an Insurance claim or involve any 3rd party in paying for the collision .

My experience: I was rear ended on 401 in April 2011. Driver 2 rear ended by driver 3 and driver 3 rear ended by driver 4. So total 4 vehicles involved in collision. There was minor damage to my car. I took my car to collision centre along with OPP report.

I also reported this incidence to insurance company. They told me that as per rules you (driver 1) are not at fault between me and d2. You can take your car to collision centre for repairing and there won’t be any impact on your premium. I don’t no what happened to other drivers.

I don’t think so there will be any impact on B. This is because collision is not reported to insurance company and no claim has been made. However as per rules, B is at 100 % fault.

6. (1) This section applies when automobile “A” is struck from the rear by automobile “B”, and both automobiles are travelling in the same direction and in the same lane. R.R.O. 1990, Reg. 668, s. 6 (1).

(2) If automobile “A” is stopped or is in forward motion, the driver of automobile “A” is not at fault and the driver of automobile “B” is 100 per cent at fault for the incident.

I was involved in exactly the same situation in 2009 at the 401 & 400. My car had just a small scratch. Actually it was the impression of the two nuts of the driver 2 nameplate on my rear bumper.
To cut the long story short, the garage billed the insurance company $ 900 and I was given 3 days free car.

Thanks to all for your inputs and Fido for the sample format too.

The part that is unclear still is whether the collision center will report to insurance no matter a claim is made or not ? So what does insurance do if it hears from the collision center.
