I am Foreign worker work as Food service supervisor in Alberta and employer terminated me without any notice. I asked them for reason for termination in written and they have not given anything until now. They went and complained to service Canada saying that i dint come for work. i had applied for PR on AINP as well as Express entry. I am bit scared now what will happen to my application.

Please advise me. I am in a bad situation.

Regards
hari

If you lose your job

Your employer has to give you advance notice before firing you or laying you off from your job. This is to give you time to look for a new job before being out of work. If they do not give you advance notice, they have to pay you for the notice you should have been given (called termination pay). The number of days of advance notice or the amount of termination pay you should get depends on the province or territory where you are working and how long you have worked for that employer.

However, if your employer can prove that they have a good reason to fire you, they may not have to give you notice or termination pay. For example, you could be fired without notice if you commit a crime such as theft or fraud, or if you lied about your qualifications when you were hired.

If you believe your employer is not following the law, you have the right to complain to your provincial or territorial labour standards office. If you are a member of a union, you may also want to get advice from your union representative.

Please read and get to know the a lot more from their own website. Also Contact Alberta: 1-877-427-3731 and you probably have done that already.

Thanks for your reply. i have been working there for past 18 month . The problem was they had an catering order to be delivered and i call the delivery company to pick up however he showed up late the employer said me to drop and come back and i did it after delivery i got 10$ tips. So return from delivery and started my work again at end of my shift employer paid the delivery charge and i asked for the tip money that was the problem . Next day i went back to work and employer started to shout on me saying that i have attitude problem and said to stop working. I ask them to write in written about the reason of termination however they never gave me. They went and complained to Service Canada sating that i didnt return to work.

Since you are permitted to look for and get another job with a suitable employer through SERVICE CANADA, Please meet with some one there in employment section and upgrade your work experience etc., and see if they will provide you a placement LOCALLY.

Good Luck.

FH.
