CPM, BJP take a stand on Imrana rape case

The 'right' and 'left' of the political spectrum have condemned the All India Muslim Personal Law Board diktat on rape victim Imrana to stay away from her husband because the alleged rapist was her father-in-law. While the BJP and Communist Party of India (Marxist) have denounced the fatwa by Muslim clerics, the Congress and Samajwadi Party have maintained a conspicuous silence.
Fearing that the Imrana case is going the Shah Bano way, the BJP has questioned the "extra-judicial" pronouncement of the Board and called for reform in the Islamic Personal Law to bring it in consonance with Constitutional guarantees. "Article 44 of the Constitutes calls for moving towards a Uniform civil Code for the country. Till such time personal law boards should be reformed to bring them in consonance with Constitutional guarantee," BJP spokesperson Arun Jaitley said on Tuesday.
Prakash Karat, general secretary of the CPM took exception to the fatwa and wanted law to take its own course. "Personal law of any community could not be the last word. If the personal law of any community infringes upon the genuine rights of women, the law of the land should take centrestage and impart justice," Mr Karat told reporters in Lucknow.
While Congress refrained from taking a stand, Uttar Pradesh Chief Minister Mulayam Singh Yadav endorsed the stand by muslim clerics. Mr Yadav, who enjoys substantial support from UP muslims, said he had no view to offer but the highest authority of muslim clerics must have taken the decision after due deliberation. "I do not know the details of the case and therefore I am not in position to comment," Mr Yadav said. He added "kuch soch kar hi nirnay liya hoga (they must have taken the decision after due deliberation)," he said.
The Congress chose to play safe by restricting itself to a general formulation that the party believed in the Constitution and was committed to rule of law. However, unlike Mr Yadav, the party did not endorse the fatwa by religious leaders.
Far from being provided succour by her family, community, Government and women's groups, Imrana is being made the victim by interpretators of Shariat, the supporters of Imrana felt. . "She is driven to destitution. Her family and husband who would be a great source of support to her are to be separated from her. She has been raped by the culprit but condemned and discredited by her own. This is wholly unacceptable under any civilised notion of the rule of law," Mr Jaitley said. He asked the National Human Right Commission and National Commission for Women to speak up against the injustice meted to the victim.
Without commenting on the BJP's stand, Mr Karat said, "Imrana is a victim. She was raped by her in-law and religious edit should have provided her succour, instead the victim has been deprived her of rights The culprit, and not the victim, should have been punished in the case. Instead of ensuring justice to the victim, the decision has added to her woes."
The BJP called for reforms in personal laws to ensure gender justice. "The Shah Bano case was a glaring example when the legislature failed this reform process. The Imrana case gives to the Indian Society an opportunity to pause, think and reassert the need for personal law reforms in Islam," Mr Jaitley said. The BJP urged all quarters, including leaders of the Muslim community who disagree with the fatwa in the Imrana case, to question the correctness and fairness of the muslim clerics' pronouncements.
