Hello CD Members,

Currently I am on the study permit in Canada and would like to know few things for H1 Visa - Usa in Marketing Dept.

1) From where I can get very accurate information about H1 Visa - Usa, meaning please recommend some US govt sites?
2) And what's the probability to get H1 Visa to work in the Marketing / Business Field? (as I am not in IT)
3) My experience is in IT sector but in Marketing dept. Does that help to get H1 Visa from IT field quota?
4) Any other suggestions you may feel that can help achive my goals of getting H1 Visa this year.

Please look at the website of www.murthy.com and the leads from the same.

H1 Visa is based on quota of 65,000 and how well your application is prepared and presented. You could get an H-1B while you are a cook. The issue is to justify your hiring at the cost of an US citizen. Means what is that is special that they were not been able to get from a US Citizen candidate.

There is no quota for any field and all are common until the magic number of 65,000 like a cinema ticket \"Q\".

Start early, get the best lawyer for putting up your application. Study the market value for a person of your calibre and do not undersell yourself. Prepare your paperwork, supporting documents and all other information perfectly.

Could you please tell me/us, what is your educational background?
since H1 Visas are issued for Speciality occupations ( which is mostly for IT and Medicine or even in Science professions)
Also if you show your experience in Markerting etc. I am sure you are NOT going to make it.

Now a days they have made the approval process more stringent and it will be a big time risk with your credentials.
I am not discouraging you but think on the above lines.
since there are employers who might come forward saying we will sponsor, but the onus is on you to provide the right documentation in support of your case. (educaional / work experience certificates)

I am also aware of the fact that many have made it without even knowing what is IT about. BUT gone are those days...

On the annual quota info, 65K is the general cap numbers, however, there is an additional 20,000 for applicants with Masters or higher degrees. For 2006 fiscal year (2005 Oct to 2006 Sep), the caps have reached.

It is relatively easier to get H1 approval if one has a US degree since evaluating the US degree is a simple task. However, the degree and the intended occupation have to be within H1's specialty occupation list and reasonably match (via education/experience/qualifications, etc) with each other. For instance, a mechanical engineer applying for an IT position may have to demonstrate competence in the IT occupation by means of certifications, additional degrees, work experience, etc.

After seeing your qualifications and or work experience ;

The Answer is ----- Theoritically - NO

With your visitor's Visa you can enter USA and do whatever you think is fit.
but the problem will arise when it comes to converting the visit visa to H1 Visa.
The problem lies with both of your qualifying criteria.
Qualificaions - None suggest you have the techincal background.
Experience - in your case is purely Non-technical.

So it is extremely difficult to manipulate the situation, unless you have the "other" methods of doing it.
ie; cooking up experience letters and obtaining at least a one year IT diploma certificate etc........:)

If I were you, "I would not fish in troubled waters..........."

H1 visa are for speicality occupations , the basic req are the job must require minimum Bachelors degree or equivalent. I am MBA and have post graduate diploma in hotel management. I am working in USA on H1 for last 3 years. You need to get your aducation evaluated from US(there are several agencies does that) If you have bachelor or equal education and have job offer where min requirement is degree, you can cetainly apply for H1, Your exp do not have to be technical, it all dpepends upon your field.
A freind of mine has BS in Hospitality from New york and she is working as Marketing Manager in Hotel on H1. Even her I-140 also approved for same job.
So check your education and exp. and most importantly have job offer. then apply.
