Hello,
I will be eligible for applying for my CDN citizenship on Nov 15th ' 2007.

Finished MS degree from US

Has anybody had bad experiences getting his H1 stamped at the Toronto consulate follwing H1 approval.

Please post your experiences.

I had a H1B stamping on Jan 2007 at US consulate Toronto, officers and all people working there are very co-operative, I got passport back next day.

NOTE: Take some CAN $ coin with you, in case if you have to get another picture.

Can I get my H1B visa stamped in June / July / Aug 2007 in case I get an approval notice?


I applied for my H1B which if approved will start from Oct 1 st 2007 and I want to start working from Jan 1st, 2008. Is that possible?

You can get it stamped anytime you want as long as you get the appointment at the consulate and the consulate approves your visa.

Based on your timeline in the next question, however, I believe you can only apply for the visa 10 days before your H1 validity date or after the validity date begins.

That's between you and your employer. Technically, during the period of H1, you are supposed to be paid by your employer.

The employer should start paying you once you join the company i.e. ONLY after activating your H1 status with the company.

Having said that, you can join on Jan 1, 2008 if your employer is willing to wait from Oct 1 to Dec 31.

After having joined the company what are the rules regarding paying tax on H1B.

In case I joined on Jan1st 2008 and got my project on May 1st do I need to show that I was paying tax for the first four months?

Tax is not a simple topic. However, to simplify, the answer depends on where you live. If you live in US, you file 1040 as a tax resident. If you live in Canada and commute to work in the US, you file 1040NR as a tax non-resident and file Cdn taxes, take credits to offset the taxes already paid.

You will file for the calendar year whether your income is for part year or full year. However, based on where your residence is during the tax year, you may have to be under dual status.
