Respected Masood Ji:

May I request your good-self for the advice.

I got medical done in July 2003. Have paid ROLF, Proof of Funds, PCC etc.
I didn't get interview waiver letter. Also not cleared IELTS and was not asked by CHC.

1. When should I expect for final decision ?
2. Is there any chances for the interview ?
3. May be delay is due to IELTS ? Should I submit IELTS result ? If so, will 6 band work out for interview waiver ?
4. I sent 2 reminders/Faxes to CHC, New Delhi but no response.
5. I am under old rules and also getting 66 points (without including Language points) according to new rules.
6. I have also applied for CAIPS ? Will something clear from CAIPS ?
7. My Brother-in-law (Sister's husband) recently got his permanent papers on the bases of refugee act and his family(my sister and kids) is still in India and likely to receive the papers soon. My question is Can I claime 5 points on bases of blood relation ?
8. If a candidate got PR visa on the bases of Manitoba PNP, Can he/she move/settle in other province under law ?

Your help is really appreciated.

- DON'T KNOW

-YES

- YES

If so, will 6 band work out for interview waiver ? AS LONG AS YOUR TOTAL IS 67, YOU'LL BE OK REEGARDLESS OF IELTS SCORE


4. I sent 2 reminders/Faxes to CHC, New Delhi but no response.
- PATIENCE

5. I am under old rules and also getting 66 points (without including Language points) according to new rules.
- THEN YOU ARE OK.

6. I have also applied for CAIPS ? Will something clear from CAIPS ?
- HOPEFULLY IT'LL GIVE YOU AN IDEA OF WHAT'S GOING ON

7. My Brother-in-law (Sister's husband) recently got his permanent papers on the bases of refugee act and his family(my sister and kids) is still in India and likely to receive the papers soon. My question is Can I claime 5 points on bases of blood relation ?
- YES, IF HE IS A LANDED IMMIGRANT

8. If a candidate got PR visa on the bases of Manitoba PNP, Can he/she move/settle in other province under law ?
- YES

Would request again to clarify the following:
Coming to question No.
2. Can you tell why chances are there for interview.
3. CIC has mentioned that passing minimum score does not guarantee the selection. CIC reserves the right to refuse an application regardless of the total points. So Visa Officer may refuse the application if he determine that a person with bad score in IELTS or weak proficiency in language may not be able to establish himself successfully in Canada.
7. I have my brother-in-law(Sister's husband) who has received the status of landed immigrant(on the basis of Refugee Act). Can I claim 5 points on that basis. My sister is still in India.

If interview will be there, I think they will try do it before medical expire.

I really appreciate your advice.

There is always a chance for interview if the evidence and documentation submitted is not enough, or does not *conclusively* prove whatever information you have put in the application form.
If there is anything left to verify, clarify, confirm, etc. the officer can always call for an interview - at any stage.
Also, sometimes there are quality assurance interviews for their internal processes.
Not because of anything missing in your application, but simply for their QA reasons.

Yes, this is true.
The opposite is also true - even if a candidate does not secure the pass points, case can be approved on a discretionary basis.
But this happens very, very rarely.
Similarly, rejection of a case where the applicant secured enough points is also rare - but it can happen.
If it does, you can always apply for judicial review.

I don't think so.
You would have got 5 points if your sister had been living in Canada.
Since she is in India, you cannot get those points.
