I Consulted many lawyers but still not satisfied with the answer and still confused. I would appreciate if I can get your advice on this problem.
I have filed my Immigration in July 2005 (with exact 67 points)…Buffalo Office
I got my File number in August 2005 along with the letter saying that I need to appear for IELTS exams and will have to submit my score BEFORE DEC – 2005.
I appeared for IELTS and I got the overall band score 7 but in Speaking I got 6 points.
So Now it may reduce my 2 points and since I have minimum passing points of 67,
It can be a problem for me.
What will be your advice in this situation where I have to take a decision in 2 days.
- Should I ask for an extension from immigration saying that I will appear for IELTS again?
- If Yes,
o what is the procedure for doing that?
o Should I submit current score along with the extension request?
- If No,
o Should I just submit this score with out any extension request and after reappearing for IELTS and getting the new score just update the file after 4 months?
o What are the chances of my application rejection bcoz of low points during the time when I will be preparing for IELTS.
Help would be appreciated.

Dear Arts,
Your problem is not clear , it's individual scores that count in IELTS and not overall, so you need to check that. The score card is any area greater than 7 = 4 points, between 5-7 = 2 points and 4.5 = 1 point. So calculate your score accordingly.
If you needed 7 in each , which appears to me is the case, then your best bet is to ask the visa officer for some time and as evidence of taking the test, send a copy of registration recipt to him as well.
But note that you can repeat the IELTS only after 3 months of taking the test.
Declaring that you have taken the test might not help you because Visa officer might take decision on the basis of this test only and could refuse your case.
In my opinion your best bet is to request the visa officer for grant of some more time to submit the test.
to repeat IELTS you need to pay fees again and register yourself again for the next avaialble date but minimum delay must be 3 months from the date you took your exam.
