Hello Friends,

My friend is planning to sell a home that he bought on his own but does his wife need to sign on the papers to sell it ?

she is not the co-owner of the house, she is a house wife and is not present in the mortgage either ?


Is there a way he can sell if she is not ready to sign papers ?
Any information would be appreciated.

Hi Srikanth,

If the home is a Matrimonial home under the Family Law Act., the spouse must give the consent even if he/she is not on the title.

I strongly recommend you to ask your friend to seek legal advice.
