Hi ,
I have queries related to Municipality tax rule for condos in Quebec.
I bought a newly constucted condo in Dec 2004.
Though I am the first person who started living in this condo I am not the first owner.
The first owner got ownership from Nov 16,2004 and I bought from him on Dec20,2004.
Recently I got municipality tax bills and school tax which is calculated from May23,2004(That was the date when construction land listed under Municipality).
When the lawyer (that guy worked for me as well as the first owner) during closing adjustment on Dec 20,2004 before transfering ownership to me could not onsider land tax before Dec 20,2004 as the info was not available and first owner also not paid anything till that date. Now my questions are
(1)Do I need to pay before Dec 20,2004 tax precisely from May 23,2004 though I was not owner that time?
(2)Should I send all the bills before dec 20,2004 to the lawyer so that he can do the adjustment? In that case do I need to pay the bill now and then wait for lawyer's adjustment amount?
(3)Because the first owner bought on Nov 16,2004 who should pay municipality and school tax between May 23rd and Nov 15,2004 ..should it be the constuction company because they were the owner of this property.

Thanks for your help.

Hi,

If your property was in Ontario, I could have certainly answered your question. However, the rules here may not apply there in Quebec (most certainly).

I suggest you to talk to your real estate agent through whom you bought the property. He should be able to guide you or speak to the lawyer who did the closing for you. They both have an obligation to be truthful and accountable to their clients.

Good Luck!
