My brother had applied for immigration on 2001 at CHC new Delhi. In 2003 he got the letter for Ielts exam. But he did not give yet. Now On March 14, 2005, the Federal Court finalized the terms of settlement. As per this those who have applied Jan 2002 will be treated as a old case. I need you suggestion regarding IELTS exam .Does he has to give his ielts exam though he has to consider as a old case ? Pl. suggest. And what is the chances for him ?

My second question is can me and my brother jointly sponser my parents as in the form only 2 options are there like spouse name and common law patner name?

Better to have IELTS.

Two siblings can't co-sponsor parents. It has to be one of you [whoever meets the income requirement].
