Hello All,

This is Abhishek from Hyderabad, India. It would be helpful if you guys help me out to deal this situation.

I applied my Canada PR to CIC, Buffalo Office (from Toronto) on Oct, 2007 and then after I received CIC letter regarding Language Proficiency Test. I appeared on IELTS- General (English) Exam from Hyderabad itself and scored less marks, required for smooth processing of my application. I sent that my IELTS result to Buffalo office and then after few weeks, I received another letter to say that they had calculated my total points and had taken decision to close my PR application, (because of few lesser points -sort by 3 points). I requested them to reopen my application and give me another chance, so that I can re-submit some additional documents (such as another IELTS exam, current Work experience letter) to support my application. However they didn’t consider my request and suggested me to apply again when I have sufficient points.

After then I found that CIC has changed Immigration RULES such as structure of IELTS numbers (Sometime in JULY-AUG, 2008) for SKILLED workers category. I again reappeared on IELTS exam on Sep, 2008 and scored more marks. As per new rules, now I am eligible to apply my application once again. Currently I have 68 points after calculating new IELTS results + Work exp + others.

I would like to know, does it possible to re-open my old application that I submitted at Buffalo Office (Submitted on Oct, 2007) and would like to claim new IELTS points on that same Oct, 2007 Application? If yes, then how can I do it?

Hello Abhishek,

Thank you for requesting specific help. I will explain to my best as to what is taking place and where your application failed. I will also give you proper directions to follow.

The Immigration system that we are currently following is an extension of the old system that you first applied to get in. You know where you fell short. You also know what their response was as you have it in front of you. Since you failed in that attempt, they will close that file. Any fees paid for processing was utilized for that purpose. Having failed their selection process, they got you out of their system. All these are done by the system, and it take place automatically, mostly because the system gets fed with the proper data that you provided, which eliminates you in that process. It is the system that does it and I am sure you also know it.

Since you have kept pace with the Immigration system and know that the things have changed, I can now ask you to follow the current procedures. Your new scores in IELTS and the PASS marks that it will provide you will get you into the current selection process, which is a lot faster than the older system. I know there is a time validity for all of the details that you are going to provide, so please try and keep it up to date and be on top of it at all times. You have gone through the application Process once before and you know what all it calls for and if you provide them with updated materials in your new application, you stand a chance of getting brought up to the front fast.

The requirements for your qualifications are known to them and and if found in demand, they will process the same and get you an entry sooner than you expect. If per chance you have an arranged employment, you will get it even sooner. To do this you will have to RE APPLY all over again and pay the fees too. The fees paid are for ONE processing only. You are aware of that too. So, you will have to be sure that you score the PASS marks before you apply. Please make sure of that first.

I have not kept pace with your postings, so I am lost a little bit. I am sure you are here in Canada and can re-apply. Also you can get a work permit to stay here and be profitably employed till all of this is completed. Keep that in mind and proceed diligently till you succeed with the process.

Thank you very much for reply and sharing such useful information with us. After reading your reply, I have below understandings.
1. I have to again reapply new PR application because my old application is closed through System.
2. CIC already verified all my documents and details in my old (Closed) application, So if I re- reply under new RULE, this new application might take less time and I have chance to get PR sooner.

I have below questions:
1. Is it possible to HIRE immigration LAYWER from Canada itself and submit a request application to CIC for re-opening of my old application?
2. How will CIC, Buffalo Office treat my new application? Does reapplication work or not?

Currently I am in India. You know, Immigration processing time is very high ( 62 -72 Months) in India as compared to Canada. So in safer side and fast processing side, If I could come to Canada on Work permit in near future then I will again become eligible to re- apply under new RULE. This new rule will take less time, as you said. I appeared in new IELST on Sep, 2008 means I have to apply this new application before Sep, 2009 and to fulfill ‘worked full-time temporarily in Canada within the last three years ‘condition under new rule. Moreover, I have started FRENCH class in India, so that I can appear in TEF exam and score some points from French exam too.

Kindly correct me if my understanding is incorrect.

Education: Bachelor Degree in Engg. (16 years of full time study) -> 20 Points
Ability in English: IELTS (L -> 2, R-> 4, W-> 2, S- 4 = 12 ) -> 12 points

Arranged Employment -> 0 point
Adaptability: Principal Applicant or Spouse / Common-Law Partner has
worked in Canada Worked full-time in Canada for at least one year.
I was in Toronto on Work permit for 1.1 Years (Oct, 2006 to Nov, 2007) -> 5 points

Total Points: 68

You have been in Canada and you have Canadian Experience. Now you are taking French Classes. When you become proficient you should find it advantageous if and when you move into Canada. Your Point count should go up after the successful completion.

If all of the above details you mentioned makes your SECOND application a strong one, I for one do not see the need to retain the services of a Lawyer and dig up the old application and revive it.

If you have gone through the current Immigration application process and the flow of the documents in the new stream, you will find that it will get you in to Canada a lot sooner than you have figured. Because it takes about twelve months or so currently for the required class. See if you fall in any of those first.

You have applied for Immigration before and I see that there will not be any difficulties in refilling the forms and paying the fees once the application is approved. Alternately, include the fees with it. They will return the same if you do not fulfill their current requirements. They might ask you if you want your immigration process started, prior to utilizing the fees that you submitted. I have heard of a few cases on this CD Board.

Applying first and leaving the requirements to fulfill for a later date, will not get you in. You must first qualify to get in and after that you apply for Immigration and not before. The Immigration Officer who sees the application has to evaluate it based upon the information that you provided and he has no knowledge of your current studies and efforts in upgrading and that was the main reason that you failed in your first. Please do not repeat the same.

Please resubmit a full and complete NEW application with a clean FRESH start.

This should clear the cobwebs that you have in your mind.
