hey everyone, my bro applied for immig from india and he got interview after 5 yrs. but in interview they said your case is rejected because you don't have enough points.
that doesn't make any sense? if he don't has enough points then why they accept the application and why he got interview.
now my question is can he challange that decision and is it worth doing it?

Hi,
I'm no immigration expert but I'm replying since no one else has (even after 100 views!)


1. If he didn't have enough points then why did they accept the application --

I don't know what you meant by "ACCEPT the application" .
a) If your brother has sent his application to their office, CIC has no choice other than to RECEIVE it.
b) As to why they PROCESSED it ---Until they went through the application (i.e. processed it) , how would they know if your brother had enough points or not?


2.If he didn't have enough points then why did CIC call for an interview.

It is my understanding ( I may be wrong) that CIC sometimes calls a few applicants with border-line points for an interview to determine on the basis of a face-to-face interaction if the applicant deserves a waiver on the missing points.
I don't know the criteria on which they decide the waiver. However, if your brother's case was rejected after the interview, it is my feeling that your brother did not meet those criteria, and so the missing points could not be waived.

This is just my logic, not an expert opinion. Please do consult an immigration expert if you feel the matter worth pursuing.

Right CIC will accept all the applications sent to them, its only when they process it then they determine whether applicant is eligible or not. so only after processing they can tell.

CIC has already said that your bro doesnt have enough points and if you think thats not true then consult a immi lawyer before appealing the rejection.
Only Immi laywer will be able to give you a deep insight in your case.

they review the application during the interview. the ppl whoes case is 100% are the ones that the interview is bypassed. (lucky ones) at the interview the officer will ask questions because they are doubtfull aabout the information you have provided asnd it is up to you to prove that you have the points you say you do. during our interview e.g the officer had doubts about our employment company. we took with us all proof of employment and the position that we said we had. thet satisfied the officer and we were granted immigration. you can find all this info on the caip notes. as to why you have been called for an interview. your brother may have thought that he had the points but the officer obviously diareed. I would suggest to all others to ask why right there and then.
