Just wanted to update you people on the situation.
For the two days, I have been talking to the property manager and he knows that I am inclined to move in to the new apartment. So what he is trying to do is that he is delaying my application so that not only will i be forced to pay 2 months rent for my extg. place from Oct. 1 to Nov. 30th but also that I will be forced to pay rent for the new place from Oct. 1 st. I have certain personal reasons as to why I want to move to the new apartment (not desparate but I if i move to that new apartment, it will save me a long commute) and the property manager knows it. He is now delaying the approval process by saying that he needs time to get a good report from my extg. property manager (?? as the property manager for both the apartments are the same). I wanted to move this long weekend but looks like I canot.
So I just wanted CD members to know that while renting they are bound to run in to unexpected problems such as this and hence please do take caution to plan the moving process well before hand.
If I am forced to take a new apartment (not the same property manager), I belive that I give him only one month's notice and take the issue to the Ombudsman / Housing tribunal.

I am sharing my experiences in order that other CD's take care not to get into these sort of troubles that I had gotton into.
Situation :
Have to move to the new apartment by Oct. 14th. due to some personal sitiation.
Why this apartment and not some other one :
rent is low. Facilities like Gym/ Sauna/ Library/Party room/ BBQ free of any cost. Bit clean apartment
What happened :
As I might have already shared with you, I gave an application to move into an apartment on October 1 st. From OCtober 1 st. I have been calling the property manager daily asking him if my application was approved. From October 1 st. to the Oct. 5th. his answer was that he was processing the application. I used to call him and many others in the same office atleast 3 or 4 times a day. Oct. 8th was a holiday. On 9th, he told me that he still needs 2 more days to process the application. From Oct. 10th to Oct 12th. he never picked up the phone (the property manager) and by speaking to others in the same building we feel that he had instructed them not to reply to us regarding the tenancy status. They always say that we have to speak to him. On Oct. 12th. I called him like 10 times and he never picked up the phone. At 3: 00 pm, I lost my temper. I said some very nasty words ( into his voice mail) about the way that he was making us go around and also worded the same e-mail and sent it to the management. When I called around 5:00 pm, the person who picked up the phone said very sweetly that a mistake had occured since they lost the application form and told us tp come on saturday to sort it out. I guess that this must have been the effect of the nasty voice mail that I left.
So I went on saturday and she showed us our application form filled and complete in all respects. I gave her a piece of my mind and told her that if she does not give me the key today, that I was going to withdraw my application. She would not do that. She told me that she was just a low level employee and that I acheive nothing by giving her a piece of my mind. She then told me (at that time) taht she will see to it that I get the apartment and once I cooled down told me that she can do nothing until monday and that she will give me a call on Monday regarding how the application processed. She told me that since all of the application was filled and the required checks made, she did not see any problem.
I left and saw some more apartment. All of them told me that the application will be accepted only on monday and that it will take 2 or 3 days to process them.
Does any CD know as to whom I can contact to teach these people a lesson? Is there an avenue that I can complain? I have written to the management, but honestly I feel that they will not do anything. The current apartment that I live in is owned by the same management and we have given 4 work orders during the past 8 months and nothing has been done.
To all who said that Canada was a developed country with services being done quickly and efficently. They donot openly take bribe in this country but otherwise, it is pretty much the same service as we get in India or even worse. Please do think again. This is the second bad experience that I have experiences in the last 2 moves.
Once again, I am sharing this horrible experience only to get ideas from CD's as to how to tackle such issues and to serve as a gentle reminder to any new CD's who may be benifitted by this thread.

This is perhaps the only thread I found on CD pertaining to lease agreements ... surprising ... I m sure there must be more but new immigrants should be well aware of the leasing rules here ...
I recall we were like one day late in informing about the lease notice ... we went in on the 1st since the 31 st was a weekend and we thought that one day would not make a difference but guess what -- they refused to accept the notice as they need full one month notice ( this was in NS ) ...
Since we d to relocate we had little choice other than paying rent for 2 months ... fortunately and thanks to craigslist we go some one for 1 month sublet ...
I have 2 questions wrt lease agreements for apartments which I would wish CD s to share their informaiton on :
1. If one has applied for an apartment and has been approved ( submitting the certified cheque needed ) but not signed the lease , can one back out ? And is the certified cheque expected to be returned ?
2. The reason why I ask this is ... we were looking into a new apartment and though we have applied and are approved , we have learnt that there are a couple of noisy kids in the apartment above and wish to reconsider ...
If we go ahead and feel disturbed by noises from above - what options do we have ..... inform the landlord / police ?
If we inform the landlord a number of times in writing , is he liable to serve a notice to the other tenant for interfereing with reasonable enjoyment of another tenant ?
What do landlords generally do in these cases ? I wished to be sure before signing the lease .....

I don’t know much about the rules here but one thing i need to add is:
When you send noticed for cancelation on your term. It’s always better to send them Register letter before the due date.
If u get into trouble then regular mail does not comes as proof (unless when you submit the letter you get signature from landlord- which is very rare)

I think you will get back. As long as you have not signed lease agreement .

Does any one know if there s an out inspection in Ontario when you are moving out of an Apartment ?
How does the landlord confirm that the tenant has not damaged anything ?
In Nova Scotia , you have an in inspection when you move in and you can notify problems to the landlord ... while when you move out , the landlord does the out inspection and charges you any damages from you 15 days security deposit you submit at time of signing the lease .
I wonder how it is in Ontario ???
