Consider this scenario:
1. The goes ahead and puts in a claim for insurance. His insurance company informs your company and they call you. Can you tell them you have already settled? If yes, what if the claim is for say $5000??? The other guy's company will have to pay because the contract is between him and that company, and you are not a party to it. However, your company will not entertain the claim since once you settle anything, insurance company has no liability.
However just let me tell you that in Ontario, each company settles its own claim and they do not get reimbursed from other company whose client is at fault, unless the claim is for a higher amount than insured. But in this case, your company will say that they are not a party to settlement, and in that case the other insurance company can always make a reimbursement claim on you as an individual.
2. The guy after say 6 months is advised by someone to make a claim for health reasons - in that case the claim can be an exorbitant amount. And again, you can be personally liable for it.
What TK has written is something entirely different. It is a payment for services rendered which can be paid in cash or by cheque. TK took cash to conceal his income, but the guy who paid it can legally write it off as expense as he has a receipt signed by TK. This is not entirely a cash deal - a cash deal is one which has no record of any kind.

If I remember correctly, the Police complaint has to be filed within 24 hrs of the accident. Check on that.

Police complaint is only required in case of loss above $1K. If the loss is under that the person can simply inform their insurance company about the loss

Hello CD's,
I was involved at an at fault accident today. I was in a hurry to come to office (was running late). At Islington and Eglinton, there was a jam and i tried to move to the right lane and i scratced the plastic bumper of a desi in a pontiac van. The damage to him was minor, just a slight scratch on his plastic bumper. Whereas to my Toyota Corrolla, the side light was broken and my bumper sunk inside.
We decided to settle for money. The desi is fairly new to Canada and said that he does not know the rules very much. A policeman came and said that since the damage was less than $1K, we have to settle it off the road.
$50- $100 would be a fair compensation to the scratch. But if he asks for full replacement of the bumper then maybe the cost would run to a grand.
Will keep the CD's informed about what happened.
