I then went to the guy's place whose 'old and almost dying van' was hit by my son. He asked for money instead of getting the thing repaired in a garage. Threatened to go to Insurance and claim that his wife got a shock in the back due to the hit and could result into big claim.

I then simply informed my insurance agent, who took note of it, but said that they will not put it on record till there is an actual claim (according to them there are many crooks in Toronto who does this sudden braking on purpose to extort money). Also IF YOU SETTLE THE CASE IN CASH, and he goes on again to report, insurance company will NOT PROTECT you since you have already taken the first step to handle the case on your own, and there is no liability on the part of the company to entertain the claim.

I was not expecting any claim. However, that guy was bold enough to go ahead and make a claim. HIS (not mine) insurance company settled the claim (I do not know how it was settled, but my insurance company had informed them that the claim does not seem to be genuine).

And my next renewal ??????????//

It had additional discount for good driving record - so I am paying lower than what I was paying last year!

In general, such claims are treated minor and does not affect insurance - unless repeated often. That is my opinion though.

Chandresh

Chandresh,

The current state is that the guy called me and I negotiated to give $100 which we are meeting on tuesday for the final deal.

Now the question is that

1. As already mentioned by you, after taking $100 if he still report to the insurance (as he has my insurance policy and details), what should my course of action?
2. As for my next renewal is on 12th oct'06 , I have changed my insurance to some other company effective 12th oct'06. Does this coincidence will help me or effect me by any chance?
3. I have still not reported this to police or my insurance, since this was a minor one. If the guy report this to make a big deal(which I hope he will not),would it be consider too late from my part to inform them?

Thank you and others who have responded . Really appreciated:p

Hi PKS,

What Chandresh said might be right. Settling directly without reporting the thing to police and insurance company may lead to other complications.

PKS,
You may skip insurance but if you are doubtful file a claim with police. These are not connected. This will prevent the other guy to file for more claim for injury. I believe if you file it then police will call him/her and get their version also.

The choice is yours..

PKS,
When you meet to pay $100 or whatever amount has been negotiated, Write the facts in paper and get it signed by him, you and a witness and also write that the money is a complete settlement for the issue.
If he signs this, then he can not file a claim again quoting your case.
For 2 or 3 jobs that i did for cash, I was paid this way.

Sidenote : It is a wonder how he settled for $100. As far as my experience goes, A rear bumper for a Toyota Corolla is $1218 from a collision centre.
Also for a small dent in the door for a Korean car, My friend claimed from the person who hit the car $800 and he got $800 in cash.

TK,
The deal stands closed today as I paid $100 and got his signature on the paper with all the details you have mentioned and closing it with the statement that "hereby this confirms that either party has no due for any claims from the insurance nor reporting to police for this case".However no witness signature was there.......

TK,
BTW, what do you mean by this? Were you using this technique to rip off money from the ignorant drivers:confused: or ???
