Notice Period is part of Service?

Just wanted to confirm from CD members

Is Notice Period a part of your Service?

“If in Job Letter, it says can’t LEAVE before completion of One Year of Service
If you LEAVE before that, you have to repay all relocation amounts.”

If this is the situation, what person can do?

Can he complete 11 months & then 1 month notice while resigning from job?
OR
He should complete actual 1 year & then 1 month notice.

What exactly rule or law states regarding this?
Is it same in all companies or
Companies can use in what ever way they want

Can some one confirm me?

The last day of your work in your company is deemed as the date until which your service is calculated.
For example, if 1 year service is required, you can officially give notice 2 weeks before the completion of the 1 year service period (check the employment letter. SOme companies require 4 weeks notice) and the leave the office at the end of 1 year.

standard contractual clause. if you don't want that part of it. tell them to take it out. then you both sign and agree.

one time i offered a job and they said i had to stay with them for 1 year of else if i resigned within 1st year, i had to pay them $20,000 .. the cost of their using a recruiter to hire me. .. but it was more for them to make sure i stay.
i told them i would not accept the job if that was a condition and they took it out. ... i still didn't join that company for other reasons, though.

but if someone is already in that contract, then

thats why confirming, as don't want to pay any charges while leaving
also its just a matter of few days
