I am getting married in August 2010. My fiance lives in US on H1 status, and is planning to get Canadian Tourist Visa before the marriage.
Once we get married and have all necessary documents/photographs, we are going to apply for his PR.
Anyone who has had similar experience, if sponsoring someone who is already in US could please share their experience as in the procedure and timeline.
Would it be better if we get legally married here in Canada/US ?
We can come back with all the pictures and all, and then get the legal marriage done here...would that help or cause trouble with the file ?
Where you get married won't matter as long as the required documentation is in order. However, in order for you to sponsor, you must be living in Canada. Spousal sponsorship, if all documentation is in order, is normally given priority over other immigration categories.
Procedure to sponsor is same as anyone else. The only difference might be the location of the consulate where the final stages of processing might occur. In your case, since your future husband lives in the US, it might be processed at Buffalo, NY.

Once u file a PR application for ur fiance, he may get stopped at the border and may not be allowed to enter canada because he is married to PR holder and has a high likelyhood of staying on illegally....
U have 2 options really.
1> Get married in canada and he stays in canada until ur application for his PR is completely processed.
2> U apply for him while he is in the US and u both stay in ur own respective countries.. considering his status of H1B , the cic will probably want to make sure u are in canada while ur husbands application is in process.
