sir i have received a letter from cic missisuaga..in which it was written than my application for sponsoring my child and my wife has been refused because i have sponsored my another son in 2003..at that time government of canada demanded from me that if i'll sponsor my son and get financial assistance from them then i'll not be able to sponsor anyone for another 10 years because my son is mentally slow..he is dependent..the canadian government signed a contract that if i take financial assistance for my child from canadian government den i cannot sponsor anyone else..
On march 9,2003 my son entered canada and after that i received a cheque from canadian govt. with a notice that if i accept it then i'll not be able to sponsor any other member of my family...and sir, i gave it back as it is...
SIR, in my refusal letter they mentioned the clause that i have been taking the financial assistance from government..but like i said..i have not taken a single penny from them..i have got a clearence letter from government office that i have not taken any money from them and i sent d letter to delhi ambassy's e-mail address...
Sir, i would plea you to tell me that what are the chances for the clearance of my file as i have not received any letter from delhi but the file got transferred to delhi office on 14th of october,2010..till today i have not got any notification from them...
please tell me that is there any chance that my son and wife will get the visa??or vot else i need to do to get the case passed from them??

Please stop using "Sir' to address a person in canada. It speaks very low of us. It is a colonial phrase which is rediculed in Canada by non desi's
regarding your case, the law says that you will be able to sponser only if you return back any social assistance that you took from the govt..(if any) which you already have sent the proof.
New Delhi does not acknowledge letters from you to them but will file them and use then when your file is processed. So sit and hang tight.
You can contact your local MP and he will surely help you to be updated on the status on the file and can also speed up your claim (legitimate claims only). Your local MP can also advise you on govt. / social groups who can help you in your claim.

Don't worry too much, your wife and son will get visa for sure. Looks like your case was rejected due to immigration has incomplete info. Any payment from goverment issued to you was showing in record but you didn't accept the payment that matter was not reflected on your record. You may have to discuss the refusal letter with a reliable immigration consultant he/she will will tell you exact refusal reason and where to go from there.
Since, Delhi mission has refused the case, you can not argue or fight with them directly but your available option could be APEAL the Refusal decision or re-sponsor.
**Do not forget you have to provide confirmation letter so Delhi mission can not refuse again for same previous reason.
Best answer and option for your case, you can get from expert immigration lawyer or consultant. Many available with no fee for consultation and some charges $100-200 just to talk and discuss your case and review papers.

dear HAMRAHI,
as per your suggestion regarding my case..i have provided the letter of "NO DUES REMAINING" to Delhi MISSION..i have sent that letter on their e-mail address..and 1 THING more sir, they have not refused the case yet..after we got refusal letter for sponsorship from mississuaga, we have not received any letter from delhi MISSION..the file has got transferred to delhi ambassy..and we have not received any notification regarding our case..
SIR, after we got a letter from MISSISSUAGA, we were able to check our application STATUS on their website..but when we sent them that LETTER through mail during there processing about the obligation on our file..and now the application status says that "it is not able to identify us using the information provided"..
1. Is there any chance that my wife and son will get the visa without APPEAL??
or we should wait for the refusal letter to come and then we should APPEAL for our case??
2.please tell me the procedure to upload anything or to send any document to CANADIAN EMBASSY..

My apology for confusion and get mixed up.
If your case in not Refused by Delhi office, you can not Apeal.
Just wait and watch, your case is under process.
Your case is transferred to Delhi office on October 14, 2010 means Mississauga office has APPROVED your aplication. Taking financial assistance issue has been cleared here. If that problem was not cleared your file would not send to Delhi mission. If Mississauga office had objection about financial assistance and you cleared with them so they don't have any reason to hold or stop your file. They notified you and you answered them. They must have checked and confirmed that you did not take any assistance, so they moved your file to Delhi office.
Now Delhi office will take some time to issue visa. This is only 3 month now, you should not expect visa in 2-3 months. Some cases takes 6-15 months or more.
My suggestion is do not try to contact Delhi embassy yourself, better you wait and let them do process at their speed. Your own request will not make them speed up but it can delay your case. If they don't ask, DO NOT write them Email. If they require any document they will ask for and will advice you how you can send too. (Most safer to send by register mail)
Some people have already suggested you, please go talk to your area MP if you really worry about your case. MP's contact only helpful if case is really delay for 1-2 or 3 years without any reason.

MISSISSUAGA has not approved the case..they wrote in their letter that th application for sponsoring your spouse and ur child has been refused due to following reason...and the reason i told u earlier..now after that they wrote that your file has been transferred to delhi for permanent residence processing..
i this case the file got transferred to delhi even after the file got refused from MISSISSUAGA...
i'll try to contact MP OF my area...what should i ask him do do HAMRAHI??
