Even passer by's would kick the thief and police would not mind.

I agree, its hardly like this guy went looking for violence. I would hope my boyfriend would do the same as him if a stranger was robbing my mother's house. I'm sorry he has to go through this hassle now. After the thief lied about his victims being drug dealers police tore through their whole house and found nothing. They should be compensated.

Utterly idiotic. In the heat of the moment, would any reasonable person expect him to do an analysis of how much force would be enough?
There's either some pieces missing from the story or the prosecutor has lost his mind. I hope the judge throws this out to set a clear precedence....
