Applying for work permit, wife is preagnant, but delivery planned in India

Hello,

Am in a serious confusion.

I have got a job offer in Quebec. My offer amounts to 82500 CAD.
While processing the LMO my wife got preagnant.
We have planned for delivery in india.
Now the lawyer has send me application forms for my work permit, and my wife's open work permit to be submitted to VFS in india.
My LMO is for 2 years and my wife has completed 4 months.

I have not applied till now as am having some doubts. Below are my doubts

1. Will my wife get a open work permit if she is preagnant, provided medicals are ok ?

2. Can we with held the xray test for my wife. In such case can we continue her application after delivery and if yes how? What are the chances of approve a visa for her in this case ?

3. If we both get work permit now, what is the process to get the newborn to Canada after delivery ?

Request someone to answer . It will be a great help for me.

Thank you for providing a very clear picture to us about the offer and your desire to have the delivery of the New Arrival to be conducted there in India.

It will be appropriate for you to disclose this fact to your future Employer, and establish the fact that it will be an event to consider during the middle of the emplyment with them. Also discuss any other issues that you want to discuss with them prior to accepting the employment with them. These are my suggestions to you and please see if they are valid ones in your opinion.

Since the delivery will be conducted there in India, your trying for a work permit does not arise. It is true that the medicals call for one such an X-Ray and it cannot be avoided. It will be to your advantage to find out from the department, if they will accept any x-rays taken prior to today, if you do have one such copy, and if so how far back will they go and accept such a picture or has it got to be taken again to comply with the current requirements.

Wait for the approval and the arrival of an LMO and the process of acceeptance to go through. If by then, you are a proud Parent, include the new arrival too in the application process. You can always inform the CHC during the application process about the advance stages of pregnancy, with a letter from the family Doctor. So, file an application together with your wife. But do attach to it a medical report from your family doctor.

You say you are in possession of an application kit. Does that mean you already have an LMO? Some employers do have prior approvals ready.You include your wife in the application process. Just like a normal family application. After the arrival of the LMO., you can inform CHC and your employer about your wife's pregnancy and make arrangements with both of them that she will follow you after due compliance and a Medical. After that she will undertake the trip into Canada as a PR when ever she gets an O.K. from the Doctor to make a travel with the infant. It could well be two years from now, or even longer.

Now just for asking, what does the high priced lawyer has to say to you in this regasrds?

Thanks a lot FH for the reply.

I forgot to tell you, am in Bangalore.

I have already intimated the employer of this situation, and they have agreed on that.

I have got the LMO, and the lawyer has couriered all the documents along with LMO and acceptance letter, to make an application at the VFS in Bangalore.

These documents include application for my Work permit , as well as application for my Wife's Open work permit.

The lawyer says, these things now.

If we are unwilling to take medicals for my wife now, then continue with my application. We will process my Wife's and Infant's application later , after delivery.

But , my concern is , if we do so, can we end up in a situation of her and infants visa being rejected. This will be disastrous as I may have to quit the job and come back to India :).


So, as you said , we will see the option of informing the CHC about the pregnancy through a letter from the doctor.

I also heard that there is a process to with held my wife's process. That is we both apply together now, during medicals she will not undergo an Xray due to pregnancy, and then embassy withholds her application till the Xray is submitted, which can be done after her delivery.
Are you aware of such a process. IF so, how can we reinitiate the withheld process ? Can we apply for the infant too, during re initiation

Immigration process for both of you will go on. I am of the opinion that both of you should apply together. (which you have done) They will suspend the medical examination process till such a time she is free to take it again. If the Immigration Officer finds time to respond, because the Health check is done by a separate section, will communicate with you about this issue, right at the start with your Doctor's report. Otherwise you will have to restart the process all over again at a later date.

I also hope that the Baby's immigration process will get completed successfully. I am also sure that nothing will be initiated for the first SIX months, as the baby will have to be ready for the medicals. Prior to that, the first three months they do not carry out any immunity checks, as the baby will have its own. Then the Shots, such as quad, will take another three months. After settling down, you will find that the next six months will take all of the time for the baby's processing. You will also need a Passport etc., which could be done anytime after the birth of the baby. So, you will have to allocate about 12 months initially, and if you are able to complete all of the requirements early, then you will be having your family there in the Province of Quebec a little sooner.

As we say, all of these are the bridges that you cross as and when you come to it.

As regards the Medical process for your wife, it gets triggered by the Doctor who will be conducting the X-ray etc.,. He will tell you when he will be ready for her, after the delivery. There will be a file number and a Medical form issued for her at thet time.

As regards the Immigration process for the child you will have to apply for the baby soon after the baby's birth in continuation, together with the Mother's. The reason being, it is an Immigration for a TRV process for them, with you as a sponsor and you have proceeded ahead of the game. Your employer will have to provide all of the required papers to you after you land and start your work. You will feel it is another process all over again. Since the Mother's TRV is in suspension, ask the lawyer to attach the baby's application papers, to hers at that time. (I think it is free of charge, except for incidentals.) Don't forget nothing can get started without a Birth Certificate and a Passport.
