My mother is 67 and living with me in a rented apartment. I claim as a caregiver on line
315 of my tax return.
While filing her tax return I just wanted to confirm if she can take advantage of Ontario Trillium
Benefits.
When I checked the ON-BEN form it says that the following conditions to be met which are confusing
--------------------------------------
You may qualify for the OEPTC
if on December 31, 2015, you resided in Ontario, and:
1. rent or property tax for your principal residence was paid by or for you for 2015;
2. you lived in a student residence;
3. you lived in a long-term care home; or
4. you lived on a reserve and home energy costs were paid by or for you for your principal residence
on the reserve for 2015.
------------------------------------------
This means at least no. 1,2 and 3 should be satisfied and if it is so then my mother cannot claim
the benefits as she is not satifying no. 2 and 3 (I read somewhere that atleast one condition to be met but I am not sure)
My question is
On ON-BEN form is it possible if she can put rent amount which I pay so that she can
claim Ontario energy and property tax credit (OEPTC)? Without the rent amount there
appears to be no benefit.
If the rent receipt is in your mothers name then Yes, you can put it in ONBEN, otherwise No, she cannot claim that benefit.

Since I cannot claim any rent and rent receipt is in my name. That rent I was thinking she can put on her tax return and claim in ON-BEN. Since it says that rent is paid for you by someone is claimable.
Just to clarify it further.

I am paying the rent and lease is in my name. This means my mother is living with me. I just wanted to confirm
if she can put the rent amount in her tax return. Rent receipt is in my name.
I also want to clarify that I have claimed as a caregiver on my tax return (Line 315)
I am not sure if she can get any ON-BEN benefits while I am getting benefits as a caregiver.
Since I am not claiming any rent amount on my tax return as it does not give me any benefits because of my high tax bracket.
So I thought that rent paid by me can be claimed by my mother on her tax return to get Ontario Trillium Benefits.
Can anybody please confirm that she cannot claim rent amount as it is not possible to get her name on the rent receipt. I talked to my landlord and he told me that only my name can appear on rent receipt.
Thanks
If your Mother had the Lease and she was to pay the rent etc., for the location, then your logic will be suitable to your situation. You can always say that you were paying for her. (The catch is Who is holding the lease, if there is one. If not, then you are in luck)
You cannot REVERSE ENGINEER your rental system to suit the current tax year. May be you can do some changes for the NEXT Tax year.
THAT DOES NOT MEAN, that you cannot try. You might get away with it.
OUR TAX SYSTEM is an HONOUR System. So, please be careful when you do your taxes. Also be truthful always. If they AUDIT You, or ask for the receipts, they will nail you to the CROSS. Your Horse will get into the sling.
( In the meantime, Also see if you can rectify it to suit your needs)
Good Luck.
FH.
