I am a PR currently living outside Canada. For most part of 2004 I was outside Canada. Now I am filing for IT return & my accountant suggests that I should be filing as a non resident. My concern is If I file declaring as a non resident will it affect my immigration status. I am under the 3 out of 5 years stay in Canada clause.
Taxation and Immigration are different items. If you are outside canada for long time , you are non -resident while you can still count the number of days you were in for your Immigration purposes..

Another thing is if I file as Non resident even though I declare my World(US) income I'll not be taxed either. (As per my accountant & also refer to - http://www.cra-arc.gc.ca/E/pub/tg/t4131/t4131-e.html). If I dont pay taxes on my world income will it have any adverse affect on my status.
If you do not pay taxes on your world income , you are not claiming residency for that year . If you claim part residency then you can pro rate your world income and pay taxes for that part of the year on the world income .

So if I declare non resident and do not pay tax for 2004 I'll still be fine as long as I move to Canada before staying out for 3 years.
Do u have residential ties to canada apt/house/ spouse / Provincial medical. Canada DL etc.
If you do then it will be difficult for you to file non-residency . If you just landed and came back in 2 days , you are fine to file non-residency

No I dont have any of these just the PR card & SIN. I am out for about 1 1/2 years now. I have a address (for correspondence etc). Last year I did not declare anything (part ignorance part carelessness). My concern is if I declare myself as non resident for 2004 will my PR status be affected. I am planning to move back to Canada later this year.
