This is your decision but you did ask CD for suggestions.

You signed a legally binding document when you went to the gym. It is *your* responsibility to pay your fees..not try to get out of them. If you didnt read the fine print.. too bad..its still your responsibility. This is life.

Here is a quote from Ontario's Ministry of Government Services regarding Debt collection/repayment:
\"Debts should not be treated lightly. They can result in court action, which could lead to money being taken from your paycheque (garnishee) or seizure of your assets. \"


Also, Credit rating IS VERY IMPORTANT. Mortgages at zero credit will charge you so much interest you will find yourself throwing thousands of dollars -maybe even hundreds of thousands of dollars. All for $1000 ? It wouldnt be worth it for me.

You need a good credit rating for more than mortgages - you need it to establish accounts with various utility companies, some employers now do credit checks, and you may obtain 'zero credit' credit cards..but again..you will be paying through the nose for interest.

I would advise to put pride aside.... and pay it asap because it is your responsibility.

Try to look at something from an analytical point of view specially when solving something tricky. I have no problem paying the money which they say is outstanding. I dont know if you really read my posts.

I am against paying the amounts due from last 6 months becuase of teh following reasons.
1-they waited 6 months before notifying me about the outstanding balance of everymonth starting july 2005. They could have informed me as soon as the first payment was rejected by the credit card.
2-They could have called me and informed me once my contract was over and told me that now you are going to be on a monthly basis.
3-They could have sent me bills.

If you think these are not reasons enough to fight it than we are on totally different levels.

Now the second thing you are bringing up is credit rating. With a credit rating like mine...I dont see one thing charring up my entire credit history of 6-7 years; besides I am disputing it so when I go for a loan or mortgage I can always explain myself and the other thing somebody with a sane head on the shoulders would look at the amount and be able to make a decision.


Now the analytical part of it.
It takes money for the gym to send my file for collections to the collection agency which is I dont know may be 20-30 bucks. Secondly whatever amount the collections agency is able to get out of me they take half the cut.

If I am going down I am gonna make sure I leave a dent on their surface.

And its not pride its called standing up for yourself and not being a wimp.

We had news all around somewhere in April / may this year (2005)regarding contracts being automatically renewed without explicit instructions from the subsrciber and the law was amended that they now have to ask your permission to renew when the old contract is ending. I tried to search for the article, but couldnt locate. Also I am not sure if it was applicable on back dated contracts...someone need to do some serious research. Personally, I stay away from any kind of annual contracts even if they offer 'attractive rates'.

Azazf, I back you on the point they should have contacted you for the first month itself.

Its hard to say why they did what you wrote below. If you still have your contract then read through it regarding membership fees/renewals and such. I can understand that you believe this is unfair. I've been in a similar situation - not related to moving cities, but because of physical reasons I couldnt continue going to the gym. I had to fight regarding payments etc.

You may want to make an appointment to see the Manager of the gym. Take all your documents, dress up, be professional, courtious and request that your last payments be waived. Explain that you HAD contacted the gym to cancel your membership by telephone. and that you were NOT ADVISED you had to make a personal appearance to cancel and that you were out of town and it was not possible for you to fly down to cancel. Say you have honored your contract by making 1.5 years payment up front however you will not pay for 6 months when you had already cancelled to the best of your ability. IF they keep refusing..
write a letter to the head office explaining your situation - put in the letter the date/time /name of manager and explain that you went to the manager and advise that you would like the head office to honor your request as good customer service.

Just from experience - being assertive, professional, not showing any emotion and being polite but firm will ensure greater chance of success. Im not saying you arent professional etc..but just giving advice :)

I called my mortgage broker a few minutes ago to clarify before I wrote here. She states one missed payment or one outstanding debt that has not been paid drastically affects your beacon score. You become a higher risk for any lender. You may be offered a mortgage by a lender, but you will definately be paying much higher interest fees (which affects how much you can borrow ie./ how much house you can afford)

u can email me a copy of the letter (if and when you need to write one) and I dont mind proofing it for you.

This is how they make money so not hard to understand.

Check out the websites of the better business bureau and the ministry of consumer affairs. They all have warnings for fitness clubs. Basically they are crooks.......I think I am going to put them in the same category as lawyers and politicians

The other thing I am going to do is cancel each and every single preauthorised payments i have going on. I think I have learnt my lesson. From now on nobody gets access to my money wehn I am sleeping. Like you had said in your earlier post learn from this experience.

Thanks for the letter offer but written communication is not my strongest forte but conversing is. I have an appointment tomorrow to see the person incharge.......I'll know tomorrow what happens.

Why are we bloody damn so scared of these crooks. Instead of gym spoiling credit history why not Azazf go and report to credit bureau or whatever it is and spoil their credit history. They should be worried more than our friend. They require more credit than compare to our friend....
