Im a Permanent Resident and wish to marry a lady on a visit visa. Can i marry her in Canada? Can her visit visa status be changed to Immigrant without her leaving Canada so she continues to reside with me? Plesae assist.

Yes, you can marry her in Canada and then can file for her PR as well then she wont have to leave Canada until the decision on her PR application is made.
But yes be prepared to give Immi officers enough reasons with proofs that ur marriage is a geniune one and not a fake.

Sir, Thank you veyr much for your reply. I would be so happy if you may give any examples of such evidence. Can some Canadian's witness be sufficient? What documents or methods as evidence may be considered adequate? Kinldy guide further.

okay i think u misunderstood me, when i said genuine marraige not a fake one, by that i meant that she didnt marry u for the sake of getting Permanent resident status. ofcourse ur marriage has to be legal with marriage certificate but it shud not be paper marriage for getting Canadian PR.

lots of things you may have to provide to immi officers to proof that ur marriage is a genuine one. eg

you both know each other from long with proofs
have u ever met her before marriage
how u met her
how much time you spend together before marraige
compatibility between two of you, in terms of qualification/age cuz if there is significant age/qualification difference then you need more evidences to prove that its a genuine marraige
Arrangements you have made in Canada for her living
Honeymoon

all these details with proofs/evidence are mandatory.
proofs can be pics,phone bills, videos, emails, mails, letters, etc etc....
Immi officers are very strict nowadays cuz of paper marriages.

Hi,
Yes,you can marry her in CANADA.She can stay in Canada with you on visitor visa.You can apply for her PR within Canada(Inland processing).The evidences which you need to show are:
1)It is better if ur as well as her parents attend your marriage.(even we got married in canada and our parents came for our marriage)
2)You need to show lots of emails exchanged betwween you and your wwife
3)Telephone calling cards
4)Lots of photographs(proof tht u know eachother before marriage)
5)Proof that she knows your frenz(not necessary but if possible)
We submitted all these...
She is legally entitled to stay in Canada with you but she has to apply for an extension every 6 months.Canada imm. dosent have I94 like USA.Any visitor who comes to canada cannot stay here after 6months.Though he/she has VISA for 1 or more years she/he are not allowed to stay for more than 6 months.Extension is not at all a problem.She might get it.So you haveto apply for her extension after 6 months.
Time lines for you ::
1) TO GET MARRIAGE CERTIFICATE IN ONTARIO:
It takes about 3months ie 90days approximately or more than that(Because MARRIAGE REGISTRAR OFFICE IS IN THUNDERBAY AND THEY ARE VERY VERY SLOW)Your marriage certification requesition is posted to THUNDERBAY
2)You need to apply for OPTION C PRINTOUT AND NOTICE OF ASSESSMENT(WHICH TAKES MINIMUM 1 WEEK OR MAX 10DAYS AFTER U ORDER ON PHONE TO CANADA REVENUE).I took 3 years statements.
3)POLICE VERIFICATION CERTIFICATE which takes 6-7 weeks(took 8 weeks for my wife to get from INDIA..we applied in INDIAN EMBASSY).

These three things are important and they take lots of time.If you have any other doubts.I may not be clear in few points.Feel free to gimme a mail.

Many thanks for your kindness to respond. I'd try to detail a bit more abt me and circumstances to seek your guidance better. I made my landing with wife and two kids in Mar. '04. Soon after landing we had to return home as unfortunately my wife developed cancer and Ontario Health would not accept her because of the 3 month wait for the health card. I lost her some months later. I surrendered her documents to the authorities informing them about her demise.

Destiny brought me to meet a lady of another nationality. We intend getting married in Canada, as friends advise us it is better and easier for us and she can get Immigrant status sooner. I cant think of settling in Canada without her as i'd be totally lost with semi-infant kids in a new place with little help and no job.

My kids and me hold PR cards. We have a few months left (max. Feb. 2007 to (re)start in Canada before expiry of the 3 year period we could be away from Canada.

She could try for a visit visa and arrive Canada with me or soon after me. I can of course show emails, pics. etc as evidence and my kids too can demonstrate their closeness to her if it can be accepted as proof by Imm officals.

Is this route the best route to go (arriving Canada and marrying)? Or is there any better suggestion/s your experience and knowledge may suggest?

Are you sure about this? If she has a visitor visa for 6 months, and if her PR application is filed in canada after she comes to canada, if she doesn't get PR status by the time her vistor visa expires, what should she do?
