I few Questions to be answered carefully ( Request )

1- I am a PR card holder since Dec 2005 , I spent four months in Canada , and came back to India in Apr 2006 . I got divoced in April which is now registed with papers in india , now I am planning to go back to Canada , i have few things in mind .

a) As i am going back after 5 months would i be facing any problem regarding my immigration status , and whats the procedure to register my divorce in canada , I have my divorce papers signed by my ex-husband , but now as he is totally lost in India after comming back from canada with me . What should I do ? Kindly tell me whats the procedure to register my divorce and take NOC or something like to marry again ?

b) I wanna marry an INDIAN guy who lives in india , what will the procedure to sponsor him , or un an easy way he has to come to canada on a visit visa and marry me there ?

One of the reasons why about 23% of the Spouse sponsership applications from India are being rejected is that many Indians are abusing the Canadian Spousal sponsership rules by undergoing fake marriages.

A typical immigration fraud case goes like this:
Person A (canadian citizen/PR) goes to India and marries(fake marriage) person B and sponsers person B.
Person B lands in canada. Person A and person B apply for divorce.
Once divorce is granted person B goes and marries person C in India


I am NOT saying you are doing fraud. But if I were an immigration officer I would definitely look your case with some suspicion

1) I understand that you were married to some one in India and you both came to Canada and obtained your PR cards etc., and stayed here for five months, since december of 2005 to end of March 2006. Some thing happened between the two of you and that action precipitated a divorce proceedings and your husband signed the diveorce papers and he agreed to it and the marriage ended between april and August of 2006. All of this was accomplished in India.
Did you have a job in Canada? Are you an individual with qualifications?. In short did you come on your own merit or as a dependant. NOW, can you stand on your own two feet and carry on working and living here in Canada all by yourself. If YES, then, you can go on in life in your own merry way and boy are you now independant?

2) Here I see you are determined to find out a few things to get your life back on track. That sure is a positive sign. You are on the right track.

3) I will try and answer, but it will be splintered. You can surely come back to Canada and re-establish yourself. (Provided no one has jerked the rug from under you, while you were busy romancing.) That is why I asked you were you employed profitably all by yourself?
Registering a divorce here in Canada or in India could be done through a Notary Public and whatever you did there could be repeated. That procedure is known to all. The cost is very minimal here too. But you will have to now undo a lot of things that will lay a foundation for a new start, such as name change to your maiden name etc., That is a procedure all by itself, and will take some time and money.
(This is coaching) To make marrying a second time easier, to an INDIAN, make SURE that the next person is an individual who is compatible and one who will hold you nearly and dearly, has qualifications that are in demand here in Canada and will work here and support you and the family, if you will have one in the future, before YOU commit yourself to HIM. Get that understanding and a secure feeling prior to jumping into it a second time. Then, since you both find yourselves in love and want commit to each other, and since you both are there, take some pictures to gether, have a few parties, which you already have done so, organise with friends and family for an engagement, take a few more pictures together with your new boy friend, or fiancee now, then get a bunch of pictures printed and make an album. This individual to whom you will get married to, will then, get sponsored by you from Canada. Don't forget that you have to be working and making a decent wage to live here. (It is not a requirement, but it is what will keep you going till he is accepted by the Canadian Immigration and it takes some time) The time required for such sponsorship will be about six months, at the least. You will do better if you can get him to take an X-ray and a blood test before you do all of this, since he has to pass all of this anyway. (Don't want to upset the whole apple cart)

b) I wanna marry an INDIAN guy who lives in india , what will the procedure to sponsor him , or un an easy way he has to come to canada on a visit visa and marry me there ? ......
4) (Start a clean slate.) Once you go through all of these procedures, the Canadian Government will get to know every single bit of your life, as they have all of the access to the legal matters pertaining to your personal life, anywhere in any part of this world. They have eyes and ears and see and hear every little bit of rustle in the bush. So, go clean from today and follow the right procedures. Keep track of all of your movements. Ask him also to do the same. Write letters to each other. Take a copy and keep it for your files Before mailing. Write e-mails daily if it need be. print them and keep them. Keep track of the phone calls and thier duration. The time that you spent together in india. Hotel and motel bills, money spent on get to gethers, food bills, cost of anything else that you gave each other. Now while all of this is in progress, get back once again to India print a few wedding invitations and legally marry him there and go and visit the CHC and drop the whole pile of evidence in their laps and ask for a Visa and ask them to let him travel with you and tell them it is a honeymoon onwhich you are taking him to in Canada.

What more can I say? You are young, no more than twenty five? and a fire cracker, you are free, independant, a self starter, with pep and vigour and outgoing too.
