Dear Friends in this forum.
Happy New year to you all.

My case is very simple and straight forward and I need your advice.
---------------------------------------------------------------------------
I landed in Canada on 6th June 2003.Stayed only for total 3 months ( 3 visits ).I am still working in Dubai and certain personal cirumstances kept us from not moving to canada for good.Now scenario has changed but we have no time left and have legally lost the opportunity to complete the 2 year period of stay.Hence cannot renew the PR card/status.The PR Card would be expiring by 5th June 2008.

Was there a way that we could be :

1.Allowed to enter canada with family in such situation
2. And later we could Stay with the 'expired PR Card' and apply for its renewal only after 2 years of solid stay over there?

Is there any chance left ??? Can any lawyer help ?

Or should we finally say 'good bye' to immigration canada.

Any advise from you legal guys would be highly helpful.

It seems you are like the thousands of others who need to leave Canada after landing for 'personal reasons or emergencies'. This issue has been discussed thousands of times on this board.

Since your PR card is valid, you are welcome to try entering Canada. You'll have to take your chances. Of course you may be refused entry if you are unable to prove that you have fulfilled your residency obligations.

Frankly there was no emergency in my case , but pure personal reasons.
What can happen after if I am able to enter Canada with my family without any hassles? can i then stay and work on (expired) PR card (which would expire in couple of months).Will be able to avail health facilities despite of the expired PR card ?

I don't think your expired PR card is going to be a major issue. You can apply for a new card when you are here. I would assume you would have applied for your health card etc. prior to your PR card expiring.

Really, as long as you are able to get in Ok, the rest should be fine.

Thanks yellowknife.

So ultimaltely it is matter of "chance" at the entry/immigration check.I also read somewhere in the forum that as long as one's PR card was valid no one would stop entry.But surely no one can predict the circumstances!

Will it make any difference that I entry through Calgary instead of TO ? would it complicate the matter instead ?

If all of us (family) enter same time (and card date is ending), would be it be better or if they(family) join me later ? any ideas ?? which would be an advantageous situation ?

The best thing to do would be write to the Canadian embassy and find out.

Entering from Calgary or TO or Vancouver or any other place will not make a difference.

I read in one of the websites that if you travel from US to Canada by road in a private car, the officials at the border will not check.

Once you enter canada you can continue to stay and apply for citizenship after you complete 3 continuous years of stay. I understand a valid PR card is not required to be employed in Canada. However, you will not be able to leave Canada in case of any emergency and re-enter without a valid PR card.

We are also in the same boat as you are and we are planning to enter Canada from US on a private car in May 2009.
