The answers are YES to both your qs .
Write to the CHC - there s a humanatarian clause in which PR exceptions apply - but that is uncertain in outcome unless decided by a judge in Canada - which can be an expensive option .
Since 2-3 years is not a long period , if i were in your place I would write to CHC , explain my situation and await their reply . If negative I would rather re apply and wait OR possibly check out the Australian option as you get citizenship there in 2 yrs instead of 3 and much better weather .
