PR_US, I am not really sure on what basis you will 'appeal'? If you plan to clearly state in the app that you have been outside Canada, then what are you going to appeal?
I assume what you are saying is that you will 'truthfully' state in your app that you have not stayed in Canada and thus don't meet citizenship requirements. You feel that your application will be denied and then you will appeal?
I really don't think you have any grounds for an appeal anyways, and I think kunato's post is quite clear.
Actually, I think your application should not even make it to a citizenship judge and cic will reject it outright. If I am not mistaken, cic tends to send the app to a judge if it is a relatively borderline case in terms of meeting stay requirements(eg. if you are off by a few days).

I will be eligible to apply in Mar 08 based on completing basic residence requirement. You are correct technically it will not be an appeal (I misworded it). I was in Canada physically from Sep 03 - Aug 06 but not all stay was as a PR. I plan to base my application based on my request to consider me since I had to move out for my studies not for work. Also since I have spent considerable time in Canada I might have a chance.
I am not able to get a good job in Canada currently and it might take me a couple of year to move back. I might lose my PR if I don't move back within 1 year of graduating. Some companies want only citizens so that can travel for work to US easlily!
If I get citizenship I will have more opportunities.
Can you live in Canada near border and work in US, commuting daily? That will meet both your requirements?
