I sponsored my conjugal partner in Nov 2003 and our application was denied in May 2004 because the visa officer did not believe we had been in a conjugal relationship for over a year and wanted to see more of our affairs combined.
We filed an appeal in June 2004 and now are waiting for our appeal hearing in September 2005.
My main question is about the process after a successful appeal. Is there any time period that the case must be reopened by CIC and the original visa office? I believe that the case is then treated as a new, fresh application - is that correct? Would this mean that after a successful appeal, it could be several months until the application is finally allowed?

Usually takes approx. six months after appeal for spouse to get visa. This is at Delhi.
On a side note: Is someone representing you in this appeal? If yes, then why ask this question on this forum and not your lawyer? Just curious. I'd appreciate your honest answer.

Thank you for the response. the visa office that I am involved wtih is Buffalo though so I imagine the processing is different.
I do not have a lawyer representing me. Hence the reason I asked on here.
