I am just waiting call from lady, till now she didn't call me,
shall i call her and found out what is going on or i wait ?
shall i go first and report to collsion centre or not?

B'cos she told me that she is working with insurance co. may be she is thinnking to make money from me. i have a no idea as now i am totally in pressure rightnow.

If you have any idea please let me know. as i know her car and my car if i am going to fix that will cost me more than $2500 to 3000. only her car may be 1500 to 2000 dollar.

If anybody knows any collision centre address at mississauga please let me know as i am living near squear one area.

My bad luck, Yesterday night at around 11.00 p.m. i got an accident with my family at near Dixie rd and Queens st. (Queensway??)

I went to one of my friends house to see his new born babby, at night when i returned from his house i got into an accident with one car. I was taking right turn from building and suddenly one car came from my left side and I hit with that car. I did not see the car due to a Big hill of Snow put on the left side. Even luckily i had camera with me and i took some photos on spot of my car and situation. When i took slightly down my car on the road and i hit car which was driven by black lady with her family.

Now lady told me she is working with insurance co. and she called the police, but my bad or may be good luck Police told the black lady if both car are drive-able than we will not come but you just exchange your information and infom tomorrow to collision center, and there was not witness. I asked lady and she was agreed to fix car outside of insurance issue, but she told me to sign on paper that i am agreed to pay all expenses will occur to fix her car. Her car both passenger side door bend and scratches. My car got damage only front bumper and lic. plate torn. Now my questions are:

1. As per rules am i in fault or Not?
2. If yes is it advicable to inform myside first to ins. co. or i have to wait for the call from lady?
3. If i am involve my insurance co. Please anybody explain how much percentage of my insurance will increase as these my first involvement in accident.
3. If i am going to fix my and her car outside will cost me around $3000, is it worth (ful) to pay outside or should i involve ins. co?

I know in these site so many questions are rising like me and you people help each and everyone. i am really in now trouble and more in confusion to what to do? If any suggestion will be very helpful to me...

Regards

Here is some help with a nice article from the CITY NEWS:
http://www.citynews.ca/news/news_6957.aspx

This accident happened Last Night. Go to the collision center for reporting accidents. There is one near HWY10 two intersections North of HWY 5 on the left hand side, and get your report in. Check the others in the link. They are open till 20:00 hrs and they do not take any reports after 19:00 hrs, you have to be in there one hour prior to closing. There might be other all night reporting centers and you can call and find out if there is any.
If the other party does not report, then she will be at a loss in answering to her insurance company.
You say there were no witnesses. Did you have occupants there in your car or Passengers in the other Car. (I know they are not witnesses, but can support you in your statement)

Collision Reporting Centers:
* What are Collision Reporting Centres?
* What actions should I take before going to a Collision Reporting Centre?
* When should I go to a Collision Reporting Centre?
What are Collision Reporting Centres?
A Collision Reporting Centre is a facility created to help motorists in reporting motor vehicle collisions. This service is currently available in a number of urban centres. No fees are charged.
What actions should I take before going to a Collision Reporting Centre?

1. If it is safe to do so, remove vehicles from the roadway.
2. Call Police to ensure police presence is not required and obtain the location of the closest Collision Reporting Centre.
3. Exchange information with the other involved parties, including independent witnesses. (Names, addresses, phone numbers, insurance companies and vehicle particulars, etc.).
4. As soon as possible, bring your vehicle to the Collision Reporting Centre most convenient to you.
5. Bring documentation with you to the Collision Reporting Center (e.g. driver's license, ownership and insurance, etc.).

When should I go to a Collision Reporting Center?
With the following exceptions, any driver involved in a collision where damage to vehicles or property is more than $1,000 may report the collision to a Collision Reporting Center. Police will come to the scene when one or more of the following situations apply.

Exceptions
1. Collisions involving injury or death.
2. Criminal activity involved in collisions (e.g., impaired driving, stolen vehicle, assault, etc.).
3. Collisions involving federal, provincial or municipal vehicles (including transit vehicles).
4. Collisions involving a person who is uninsured or is a suspended driver.
5. Collisions involving vehicles transporting dangerous goods.
6. Collisions involving damage to private, municipal or highway property.

***Without exception, towed vehicles must go directly to a Collision Reporting Centre.

Since you both drove back home in your own vehicle, please proceed and report the same and stay within the guide lines. ($1000.00)

(Don't forget that the other driver (She) might not have had any brakes on her vehicle at all or very bad tires to top it. See the pictures that you took show the conditions of any of the tires. Any one who returns after 11:00 hours, including yourself could have consumed a good quantity of alcohol also, which surely would give them the ounce of courage but impairs their ability to drive)

Some times the premiums does not go up. And a storm like this will increase the premiums for very bad drivers the next time it comes up for renewal.
The insurance companies are there to make money and not loose, so beware of it.

The collision center will check your front bumper sensors and see why the air bags did not deploy, if found defective will replace the whole bumper when you report to your insurance company. I want to make sure that you and your family members who use that vehicle are protected to the hilt, if the sensor was found defective.! (Call a Toyota dealer and see if he can help you.)

Don't be that worried and stay under pressure or stress. Most of the insurance companies don't fix anything because they take the age of the car and wear and tear under consideration and tell the other driver "YOU GO AND FIX IT ALL BY YOURSELF", Because your car is a junk!! (Or go fly a kite) They can't sue you unless they can prove that their car had all new parts and show you the repair bills and the cost of those parts also.

Stay calm and cool and now ignore all the calls from the other driver. DO NOT RESPOND.

Hope this builds up a little confidence and a little courage in you and pulls up your jock straps.

Freddie.

What happened ??

As I was reading this thread , I found the conclusion missing ... maybe RBO can update us on this ....

Does reporting to a collision center bring this into the Insurance company's records even if the parties decide to get the cars fixed out of Insurance ??

Plus I also wanted to ask - whats the best step to be taken if you are involved in a 'not at fault' accident ... Should you accept payment from the other party (out of Insurance ) or go ahead with reporting to Insurance company ....

How do you ascertain if the other party's tires / brakes were unfit or if was impaired ? By the next morning the alcohol levels would go down ....

I think ... it might be prudent to take pictures on the spot w/o moving the vehicles , exchange all information and then go home and decide ...... I hear some radio ads on 'accident and slip & fall advisers '.... and the best line is 'galti aapkee ho ya na ho' ... (whether you are at fault or not ) ... :)
