Hi there,
I got married in canada to someone who was under visitor's visa sometime in 2005
thereafter we have renewed the visitor's visa to apply for landed status under the spousal programme
i submitted my application and received my the immigration on 30th Jun, 2006
since then i have not heard from the immigration and according to the website they will notify within 9 - 10 months unless they need further information
yesterday i gave a call to CIC and found out that the papers are in process and i have to wait for them to reply and they also told me that my wife's visitor's visa already expired and since i failed to renew within the prescribed time its the officer's discretion whether to reject the application and request my wife to return
is it true that i cannot appeal against the rejection because its within canada application???
i was also told by CIC call centre in the event the application is rejected, my wife has to leave canada immediately and submit fresh application from outside canada
do anyone encouter similar problem? please advise
thanks
Hi Ashawin,
I didnt had any similar experience, lets wait and see if any senior members have any suggestion or post your question to other immigration forums which has more members who had applied under the in Canada class...my fav is immigration.ca
Good luck
MS
Kindly post these details to the "sticky" thread of Spouse Sponsorship . it has got better chances of being answered there and may help someone with the same problem later also.
