We landed in 2004 and in July 2009 validity of our PR card will expire. Since we will not meet the minimum requirement of 730 days in canada during this period, we will loose our PR status and hence would like to file our application for re-immigration.
When we re-apply for immigration, do we have to wait till July 2009 till the validity of the PR expires or can we reapply for immigration immediately.
If we can re-apply immediately, do we have to first inform the Canadian High Commission and ensure that the PR status is lost officially or do we have to relinquise our PR status first before reapplying.
I would really appreciate your views.
You are one and the same individual who is re-applying for Immigration to Canada and you should not have any difficulties to obtain the same. But please quote your old file and case number that they have provided you with and ask them to cross check if need be. Ask them for the required fees etc., and please tell us how it got processed. Your application will be the first one on this board. Once they refer the old files, they will know that you have not been able to fulfill the required qualifying days.
They might ask you to undergo the Medical Checks and go through the whole process and also pay the additional fees too. So, be prepared for the same.

1.Can some Legal expert in immigration answer the above questions please ? I am also into same situation !
2.Moreover would the whole process would again take 2-3 years or less this time ???
3.Is it better to handover the PR Cards at the embassy before expiry of cards and then apply afresh ? will that help in re-processing of the application ?
Any ideas,comments and experiences are welcomed.

Your application will be the first one on this board. They will know that you have not been able to fulfill the required qualifying days. They might ask you to undergo the Medical Checks and go through the whole process and also pay the additional fees too. So, be prepared for the same.
You have been to Canada and stayed here and have the first hand experience as to the living conditions and job requirements too. Since you entered, you also have that many years of experience also that will give you good marks and more points in your next application.
If you had more training and education in your line of work or studied another language, such as French, you will be able to provide them the details and the progress that you have made. That will be to your credit and will make you more suitable. Also if you think you need more training and you have to enter into an educational institution here in Canada, you still have your remainder of your term of FIVE years to enter into Canada and complete the studies. If you do have time on your hands, please visit them and get all of the details in person. Also explain to them the difficulties that you have in India, if any. See how they can help you with the humanitarian and Compassionate grounds angle. Also inform us here with your progress and any other assistance that they provided to you.
Please hang onto the PR Card, because that is the only thing that you DON'T have to return to them, it is the proof of YOU being in here., in Canada. Once issued it is yours to keep.
You will be the only one that will know how long it will take the second time. So, please inform us and keep us posted. It will surely take the same amount of time, unless you go through the educational system and a open work permit. Bring this up in your conversation, when you meet with the people who are there to help you. See Link.

Side Note: Since you both are in a distant location, I was able to contact the CIC here in Canada and I was informed that you do not, repeat, DO NOT have to wait for re-application and since you did qualify prior to this and were a Landed Immigrant, with SKILLS, you can apply under the Skilled Immigrants Category and see how fast it goes through.
