My Tn status got denied as my degree and experience doesn't match.
I have Bachelors degree in commerce.
I have equivalent canadaian credentials and have 5 years experience as developer ,my developer role involves sysatem analyst job too.
I got a job as system analyst in U.S.My employers lawyer prepared the Tn status application.But Us immigration officier denied my tn status as my experience and qualification does not meet.
My Lawyer is asking me to reapply ,making some minor changes in my resume.is is possible that i can get Tn stamp?
Can some one advice me on this.

You may reapply as many times as you wish. Only the immigration officer can answer your question since your original degree of Bachelor's in Commerce will still come into play in the decision making.

With a degree of commerce , the role of business analyst or management consultant might work. A developer will be never taken. You cannot change your degree but can get the job title redone and mold the past experience accordingly.
Isn't it strange that in this day and age when it's proven that IT doesn't require an Engineering Degree anymore, US is hell bent upon matching Degrees word by word with IT based employment. In my opinion, they certainly need to change their rules in this regard.
To the OP, yes please get your application refined as Business Analyst or Mgmt. Consultant role if your employer/lawyer approves. The only way for Business graduates to get through.
Another question - What happens upon the expiration of TN? Would the applicant still need to go through the same process, or the renewal is rather straight forward and easy?

1. Bachelor's in Commerce might be a 3 year degree while TN might require a 4 year degree (although not specified in the occupations list)
2. The applicant has the choice to mail the TN petition to the USCIS for a more thorough review (at the cost of longer lead time and more scrutiny either on the + or - side). This will eliminate the quick and presumably logical review done at the POE.
3. USCIS has to have some filter to adjudicate TN to control the crowd of non-immigrants. The degree is one of those filters.
4. Management consultants generally tend to receive a higher level of scrutiny since it is a "vague" title. So, I don't know if that title would hurt or help.
5. There are no renewals with TN in its true sense. Every application is treated as an independent application and its merits are checked accordingly.

Still for IT occupations, which is more broad I don't think there should be a hardcore requirement for an Engg. degree. Employers are aware of it, and so should the authorities. However, as seen with Canadian immigration, the situation is not ideal. What the Government and Employers/Companies want are different.
I am still not sold on this, vis-a-vis IT. Other fields, yes agree, there should be requirement to match the job offer with the education stream.
